What I said - sort of :D

I tried to point it out on page 7 but was ignored!!

They really have committed a serious breach... they have breached their own contractual terms of service..... which they impose, and they have committed significant secondary breaches of the 1988 act....

They need to understand what the implication of those secondary breaches are.....

I have flagged up all of these issues to the legal / publishing department and they are looking at all of these as we speak.

Nothing is happening until they advise us of the actions / outcome, you will be the first to know and your details are not going anywhere.

I am now away until Monday but I have been assured its in safe hands so trust me on this one and nobody is going outside of the law and someone from IPC will answer all the questions directed at them, I suggest forward them to Natalie who will forward them accordingly

I am afraid its outside of my area but I am only answering these questions as I can see and indeed understand the concern surrounding this.

I only saw the thread on the 6th like everyone else on here.

I am sure that you had nothing to do with the deal..... but this needs to be addressed...

Well, lets give him a break, he is going on his hols and I think we all know what the score is.... someone higher up will undoubtedly be looking at this.... So, maybe we should just sit back and see what happens!

i have posts all over the web from many sites...is it a problem for me?...Now if it was PM's or addresses or email addys ...then that may be a problem...

What I want to know NOW

When the sale went through ?
What was agreed (in regard to content )?
Why was this done with out consent ?
Why this was done without formal notice ?
Who is responsible ?
Who do I sue ?
What content was transferred ( although it is obvious by looking at the website, but that could just be the tip of the iceberg )?

And more

IPC Media sold the magazine Classic Boat and the associated Classic Boat website and forum content to Chelsea Publishing late last year. Chelsea Publishing now own all Classic Boat trademarks, content and associated data including forum names and email addresses of people who have posted to the Classic Boat forum. .

More than implied, it has been categorically stated.

I contributed to the Classic forum because I felt that I would be amongst like minded people. In the main, that belief has been vindicated.

However, I do not wish my questions, opinions, comments - let alone my e-mail address (!) sold to ANY organisation without my consent.

The very notion that this can be done - and assumed to be welcomed! Beggars my belief.

You don't know the details of the contract. Forum names are not identifiers of personal information, and it could be that they are allowed only to email existing users of that specific forum to invite them to join the new forum. The devil will be in the detail, and lawyers will have been involved.

We are not talking about copyright editorial material or images here, just the random ramblings of forum members. As far as I can see, IPC can do what they want with it. Admittedly, the rules don't specifically cover IPC selling the forum to another publisher, but pretty much everything else.

5(c) Submission of Material to the Website
You agree that any Material submitted by you for publication on the Website, including but not limited to any Material sent via Forums, chat services, feedback, bulletin boards or articles or any other Material submitted for publication on the Website or in using any of the Website services is done so on the following terms:

(i) you will not submit Material that is offensive, abusive, indecent, defamatory, obscene;

(ii) you will not submit any Material which infringes the intellectual property rights of any third party or in breach of any obligation of confidentiality by which you are bound – all Material must be owned by or created by you;

(iii) you grant to us a worldwide, royalty free licence to use the Material in perpetuity in any format and on any media, this means for example that we may use your Material in the print and digital editions of magazines published by IPC, the Website and on any other website operated by IPC;

As for passing on "personal data" - I don't know about you, but they don't have any of mine, except what is visible in my public profile.

I don't particularly want to find myself copied to another forum, but what bugs me is the loss of all the previous posts on the "classics" forum (without having to go somewhere else to find them) - there is stuff I might want to refer back to, like where to buy copper nails for instance. I don't see how the forum content can be seen to "belong" to Classic Boat Magazine, as far as I can see it has little to do with it, apart from the subject matter. But I'm prepared to accept that this is the deal between IPC and the new owners - doesn't mean I like it.

To simplify it IPC have sold something they didnt own to Chelsea . If i lend you a screw driver and you sell it to Brendan it doesnt mean Brendan now owns that screwdriver , it's still mine .If Brendan wants to borrow the screwdriver he has to ask me . If he wants to buy it he has to ask me .
To be honest if he did ask i would tell him its about time he bought his own screwdriver as he is always borrowing mine .

Actually we are.... Thats why the terms include a specific licence to cover their use.


I think we just need to wait and see what the definitive answer is in regards to how IPC are going to proceed...
