Either way 20k fine is wildly excessive for an error of judgement that caused no injury. The woman who crossed the double whites whilst using her phone to knock me off my bike and crush my leg got £200

It is a shame they didn't investigate. I'd've been interested in an intelligent explanation of how he got into that mess in the first place and why he acted the way he did once he was very close.

As I understand it ABP, who own the port of Southampton, has launched an investigation, but as far as I know it has not yet concluded. This means that we should get the intelligent explanation that you'd like.

I guess there may have been a separate court action, but if so it's not been widely reported.

£20k fine. He's appealing. Basis of the appeal is tanker gave sound signal for port but turned starboard or vice versa. This was just before the 5 blasts.

Ok - so he assumes the tanker is going to turn to port ...

(Based on the youtube video)
the yacht is STILL heading INTO the path of the tanker - had the tanker turned to port (swings the stern out to starboard) then they would've probably hit the (starboard) side of the vessel and in anycase would undoubtedly be within the exclusion zone.

Interesting that one of the comments on the Youtube page was from a guy who said he was there in a rib and that the wind suddenly dropped to nothing. Unexpected and perhaps not the fault of the skipper?

??? Not the fault of the skipper that the elements didn't save him from an obviously risky manoeuvre.
If I cross the path of a ferry on Windermere I am always mindful that the wind may drop or shift, and have a plan B.

With something that size there is no excuse whatsoever for getting it wrong. There may be reasons. But they are not excuses.

The skipper was in the wrong the moment he was within 1km of the ship's bow (in the direction of travel). That's according to the local regulations, is well known, and I'm told is also incorporated into the racing rules there. Any suggestion like "X could have happened, preventing him getting out of the way" starts with him already being at fault by being in the way in the first place.

The issue with that is that the area is 1km long by (just over) 200m wide - and a small change in course by the tanker will see that exclusion zone sweep a huge arc in front of it - in places it excludes areas the tanker cannot reach, but more importantly - just off Cowes it sweeps into the western solent where the tanker could reach - but is unlikely to go.

I am sure I've been in the official exclusion zone a few times - but outside the area that would cause an issue for the pilot or the escorts.
