Agreed but phase 1 there is no reasonable excuse any more only guidelines , the courts also need to take into consideration the humans Rights act, disability act, Age discrimination act, etc which are in legislation and not a guildline, we can argue guidelines all we want, no one will be prosecuted by them as the Proc. fiscal and any criminal act must have beyond reasonable doubt,. this fear of going to court is nonsense and it will never happen , in regards to a prosecution for a guideline,You are obliged not to leave home without a reasonable excuse, and I believe that the courts would take account of guidelines and advice when deciding what was reasonable. So, the question you have to ask yourself is "Do I feel lucky?" Well, do yah ... old chap?
The courts will take in many circumstances out with a government saying it is a guildline and I have quoted in this thread Ms Sturgeons exact words that say, it is not an enforceable guideline, my Post 37 , I saw it I heard it and the BBC have a recording of it , So that will be my evidence
So how would a Sheriff take that statement ,
