Sarriba,if you are not chained to the pontoon(you don't say where you are?)and if this isn't a shaggy dog story,I suggest you cast off and go to Morroco,Smir would be my preference,and sort it out from there.That should give you many years breathing space if you need it.She might follow you but then for her to start again in a masoganist country will probably bankrupt her before she even gets to court.
Keep all of us in the loop,and don't forget the film rights!!
Out of Gib,hard a port,mind the motorway,and you will be in Smir for brecckie.A little bit of French goes down well there.

How awful for you. I'm sorry that I can't offer you anything constructive but you have my full sympathy. Try not too become too stressed by it all. I'm sure everything will work out ok if you are the innocent party in this mess. These things just take time! How the hell did she know where to find you??? (that's the question I'd be asking myself.....)

Doing a runner would not endear you to the Gib authorities and I'm sure their patrol boats could out run a yacht. In addition to your current legal problem you'd have trying to escape added to the charge list!

Davey,so did she get an injunction in Gib to arrest this yacht(excuse the legal terminoligy).....so she went to a solicitor ....which followed by a court ruling ...which followed by the boat being arrested?Am I right?
These things take time..and money .Gib is a tiny place ..why didn't the "owner"clock she was there and vamous to Morocco?
All a little bit suspect if you want my opinion...

This hasn't come in yet but it might help in the more long term.

There is a proposal currently going through the European Parliament called the European Protection Order. Victims of crime who have been granted legal protection in one EU member state will get similar protection in other EU states under the European Protection Order. The legislation has been agreed with national governments and would include protection for any victim of gender violence, harassment, abduction, stalking or attempted murder. MEPs will debate the EPO on Monday(today) and vote on it Tuesday.(tomorrow)

I would also suggest you talk to a marine lawyer rather than an ordinary lawyer, as maritime liens/ship arrest is pretty specialised.

Sounds like I need to clarify a few things... don't worry, I understand why a few of you are sceptical because it sounds so bloody far fetched. We arrived in La Linea 2 weeks ago today, came to Gib on the 30th Nov Wednesday. As she has been stalking us or paying people to do it for her (we dont know) she called both marina's as there are only two. Our Marina told her there was no yacht here by that name, apparently she was at the airport when she called them, then they called her back and said they had made a mistake and there was a yacht in the marina by that name (not going to tell you our yacht name) this was Sunday.. on Monday she she obviously found a lawyer and wednesday it was served on us. Do you really think we would be waiting around if we new she was here? I dont think so! By the way, the Sherriff told us this when he arrested the boat...

Thanks mate, will show this to the lawyer on friday! And we have a Maritime Barrister who was recommended by the Sherriff.

We have already found one tracker on the boat when we left Malta last June. We have been over the boat 5 times and can't find anything else.... from what the sherriff told us, she has been wondering around the Med looking for us and has also paid people to follow us. We know this because we caught one of them in Crete taking photos of us and we approached him and strongly advised him to delete the photos (as any Aussie would) but we could not charge him with anything....
Yes, my husband is the innocent party in this and has told the truth and has hidden nothing, we have evidence, emails and affidavits from his employer, doctors, police report numbers etc....so it is so unfair that she can turn our life upside down every where we go...when and where does it stop? How do we stop it? No one seems to be able to answer that question ...

Are you sure, totally sure, that your new husband has told you everything? His ex seems to be going to extraordinary lengths... I'm thinking she's either mentally ill and dangerous or she really does have a claim on a boat that was partly/wholly paid for by her and she's therefore very angry.

Like I said, just playing devil's advocate.

I met someone who bought a cheap boat in Gib after the previous owner tried to outrun one of their patrol boats, so don't try running for it.

I was just about to tell you but due to the circumstances of us being assaulted and stalked, I am thinking I might not. Hope that's ok with you. We are new to this so perhaps I will look into how much info we should give away on here? Can our stalker read all this?

As your stalker has had the vessel arested and thus knows the exact location, I can't understand your reluctance to answer the location question that was posed by 'PlanB' in post 15.

the boat is arrested, we are free to come and go. No one else is allowed to come onto the boat. We had a workman come to the boat to simply measure something and the Marina Manager yelled out at him so everyone could hear "That boat is under arrest and you cant do any work on it or board it!." Gee we felt great after everyone in the Marina heard that! So much for privacy???

Ask the Marina Manager who will be paying the Marina fees as you are being prevented from leaving and as he is preventing work being carried out, advise him that you will hold him responsible if the boat sinks! :eek:

Certainly records of everything that has happened may help your cause, but it must be extremely frustrating, so sympahies. Do you have good insurace for the boat in case she decides to torch it? And I'D TAKE ADVANTAGE OF THE FACT THAT sPAIN IS 10 MINS AWAY TO GET AWAY FOR A LONG WEEKEND SOMEWHERE. LET EVERYONE KNOW YOU'RE LEAVING FOR A LONG TIME, TO TRAVEL THROUGH EUROPE, AND THAT MAY THROW HER OFF A BIT.

ALSO, TRY AND STAY HAPPY. IF SHE'S THAT PSYCHOTIC, IT WILL MAKE HER MORE MISERABLE..

Sarriba, sorry for doubting you. I've seen many a wind-up on internet forums and thought this was just another. Your story does sound incredible though. I hope everything works out for you.

+ 1. Put it down to a bad day at the office. Really hope this gets sorted in a satisfactory way. I can only apologise for doubting you.

At least there are some people out there that can hopefully help you. Sounds like a scary and worrying situation, and somewhat bizarre, that someone would go to such lengths as to hide trackers on the boat.

Presumably that means she knows where you are so be prepared for a confrontation. If that happens try to make it in front of plenty of witnesses, preferably the law. Try to keep calm and rational so that it becomes obvious that she is the dodgy one and that you need protection rather than her being the injured party.

Other than that I can't help apart from long distance support.

As usual on sites such as this when the facts are not fully given and there appears to be doubt in the story peeps think they smell a rat..................and react accordingly !!!!!!!

Why have you not taken out an injunction against this woman ?? You state you have all the evidence to prove her violent behavior in the past and state you live in fear of her, so why have you not taken action to protect yourselves ?

Who is bankrolling her continued tracking of you ? Is she seriously rich ?

You state you understand why people are sceptic and they will continue to be so unless
the full facts of this case are given. You can surely see why some folk think this is like something out of a James Bond movie.

Awaiting your update and to hear the advise given by you legal bod's.
