You could try joining either the Cruising Association who have a local representative in Gibraltar who should be able to point you in the right direction for legal help, or the Royal Yachting Association who offer legal advice to their members.

I hate to be a cynic but.........first post......location Queensland.......now Gib.......Nothing to do with yachting/sailing/livingaboard......mmmmm. Could this be the well known chess opening move known as the Nigerian Gambit.....? Surely not. ...So call me a cynic.

This is a genuine cry for help, these people are our friends and are beside themselves with worry. Hopefully things have moved on for them today after seeing a lawyer.

Hi everyone, thankyou sooooo much for replying to us....at last we feel like someone is out there listening to us. Firstly i need to apologise for the queensland location thingy... I dont know why it says that? We were in queensland visiting mum and dad last year for six months and working to come back here so we could sail back so oz. We only registered for this site a few days a go so we are still learning how to even write on this thing.... We are going to contact all the people who have recommended people...thankyou very much....yes we did go shopping last wednesday with a lovely elderly couple we met here and they drove us to lidl and carrefour... Forgive me for saying "gibraltar" but i am not used to driving for ten minutes and being in another country...it was an honest mistake....thankyou again for adding all your thoughts etc...it does make us feel better just knowing that other people do care... I find i dont want to say too much to our family back home as my husbands parents are elderly and live in qld and my dad lives alone in south australia...they are in their 80's and we really dont want them to worry too much about us... Ok enough of that stuff...l.we went back to the lawyers again today...spent the last four days not sleeping or eating and writing affidavits for the lawyer so he can begin to understand the situation... Poor guy he copped it today as we let all the emotion out and he had to listen to the lot...he did understand more after an hour though and he did advise us that there really is more to this than just a challenge for owndership...we handed over all our receipts, emails, etc and can prove everything we have said...the gist of the issue is that we have evidence showing all my husbands money going into her account, bill of sale, australian registration, police reports because of the assaults on us, her breaking into the yacht and theft, doctors reports for our injuries, absolutely everything!!!!! All she could possibly show is that she withdrew money from an account on the day he bought the yacht. We have nothing to hide and everything we say we can back up...the lawyer confessed that he doesnt know how she could take action if this is all she has but what ever she said to the cheif justice was enough to get the ball rolling..everyday we have gone for a walk she has followed us...how does she know that we are leaving the marina and going for a walk? We have looked 5 times for a tracker or bug and cant find anything....we do know she has paid people to find us as i confronted one man in crete. Caught him taking photos of the boat...told him to delete them and told the marina but what else could we do...saw someone else follow us in navplion...we asked the lawyer today about how we are supposed to stay safe as we feel like sitting ducks...the police cant do anything as she has not physically touched us...there are no stalking laws here apparently.... I could go on and on...so much has happened in the last few years..the assualts started as scratching, punching and pushing to throwing a thermos of boiling water over my husband leaving him scarred on his neck and chest..to pulling a knife on him and me in the last attack...what if it a gun next time??? I am going to contact the gentleman that someone suggested a few posts ago and see what he says....i know all this seems so bazar it cant be real..and believe us..we wish it wasnt..we just wish we could get back to australia and fight her there because we all feel safer when we are home but we are still along way away...oh yes, we asked the lawyer today that if we win does it that the end of it? He said that she can do this to us in every country we go to! We will end up broke before we get back to oz...how can this happen? What about our rights???.... Will keep you posted and thankyou again to everyone who has commented...at least we dont feel as alone now...will keep you posted, the aussies x

Another suggestion to contact VO5 by private message on this forum. He lives in Gib and is well connected.

Gib is a better place than most to have something like this happen and there are plenty of good international law firms who understand marine law based in Gib.

Having read your post my initial thoughts were why has no one replied yet !!!!

Who has been arrested ? Can only assume you mean your boat !!! but how can you arrest a boat ?? Do you mean (she) the boat has been impounded ??

Your fears may be unfounded and from what I read into your situation you have little if anything to worry about. Even if funds were taken from her account then surely she will have to prove they were used in part or fully to pay for the yacht. She may well claim that she was unaware of the procedure used in the purchase/sale of a yacht & hence allowed the shares to be put solely in your hubbys name...............could that be the case ?
At the end of the day you may need to prove where all the funds came from to purchase her.
If all is legit and you can prove that then she has no claim as far as I can see.

Will be interesting to hear what your solicitor advises.

Hi, the boat is arrested, we are free to come and go. No one else is allowed to come onto the boat. We had a workman come to the boat to simply measure something and the Marina Manager yelled out at him so everyone could hear "That boat is under arrest and you cant do any work on it or board it!." Gee we felt great after everyone in the Marina heard that! So much for privacy???

Sounds a bit iffy.

1) Describing a trip to Lidl as a wonderful day out

and

2) As far as I can tell there is no Lidl on Gib.:rolleyes:

Well sorry mate if we had a nice day out with a lovely elderly couple we met. They took us shopping to Lidl and Carrefour in Spain and we had a lovely lunch with them. True there is no Lidl on Gib but as I said, us Aussies arent used to travelling for ten minutes and being in another country. So sorry about that! I have more to worry about than that at the moment!

At the risk of seeming blindingly obvious, have you not enough evidence to get some sort of injunction against her?

In UK if a male did one tenth of what you describe he would probably have had a 5 mile exclusion zone put on him and be banged up within minutes if he broke it.

We were in the process of taking legal action against her in Malta as that is where she is from and we were living there at the time. My husband was completing the fishing season and the Police advised us (nicely) that if it was them they would leave Malta. As we were doing that anyway, we left thinking that we would never hear from her or see her again. Little did we bloody know that she would follow us around the world! We would have to take out an order on her in each country and then it would be only granted if she had assaulted us in that country. All the assaults and violence took place in Malta. This is the first time we have physically seen her since June last year.

I was just about to tell you but due to the circumstances of us being assaulted and stalked, I am thinking I might not. Hope that's ok with you. We are new to this so perhaps I will look into how much info we should give away on here? Can our stalker read all this?

If so ask a moderator to change it for you as google will find your posts.

Sarriba, sorry for doubting you. I've seen many a wind-up on internet forums and thought this was just another. Your story does sound incredible though. I hope everything works out for you.
That's OK Bill, I think that if I read about this somewhere I would probably think the same thing....it's like a nightmare that just won't go away. What I don't understand is that someone in this day and age, can do all this stuff to people and not be punished for it? We read about incidents like this in the news all the time and unfortunately the outcomes are tragic. Why can't the law protect us? Does one of us have to end up dead before a judge will listen? I am sorry....we are so sick of all this **** from her...
