However the "problem" only applies to a tiny number of boats that are independently imported where the onus is on the individual to ensure it complies. Boats bought from traders (whether they are builders or dealers) the responsibility is with the trader. A home builder is also responsible unless he qualifies for exemption from RCD because either he keeps the boat for a minimum of 5 years before selling or it is built to a design that is exempt. You can look it all up on the RYA site if you are bored.
 
I couldn't get satisfactory answers to the questions that I asked the broker, so decided not to waste my time and money going over there.
I know what you mean - I've just emailed a broker who's put up an ad without even a single picture and who has stated the manufacturer and length but not the model of the yacht. These are supposed to be professional salesmen too !

That is not true once you understand what it is about. There is no requirement for an individual owner to demonstrate his boat complies - most don't almost immediately they are put into use because owners modify them - and there is no check. It only becomes important when somebody imports a boat independently. It is then important to ensure the boat complies when it is first put into service. Lack of this can make it difficult to sell an independently imported boat at a later date.

For the rest of us with old boats or boats that were originally built or sold in the EEA it is a non-issue.

Its what happens.... Helped a friend sort out his boat import 2y ago and VAT was charged on the boat and the fees - I suppose HMRC argue its part of the value of the boat on arrival....

HMRC were however not too worried about the value of the boat & accepted our estimation (via the agents) of its value. I think we were within £10k of what it sold for not too long afterwards......
