very cheap tender

Well it's offered for sale and not mentioned as discontinued... shouldn;t they find an alternative for those who have already ordered one? Any corporate lawyers here? It's quite an interesting issue...

I'm expecting a phonecall from them any minute..... but I only ordered the small one- maybe they will have some of those in stock!

I guess it all depends on how joined up their system is. I can easily see someone processing the orders without knowing anything about boats, and then someone in dispatch just receiving a delivery note with "paid" stamped on it...

Actually, my outboard is 6 hp, but the tender only takes 3 - if it comes I'll just have to row it round the french canalways /forums/images/graemlins/cool.gif
 
no phone call yet I got in pretty quickly so wonder if they were still in stock at that point - reckon it is worth £50 to get the solicitor to write a letter just to see if they back down.
 
Yes I did, thought havent had my confirmation email as yet! I can practically see the envy on Lakesailor and tcm's faces towards the 'Plasticat'!

By coincidence I am sat next to a lawyer who specialises in consumer issues.Unfortunately you guys and no doubt thousands more around the world have just made an interest free loan to Compass Marine.They can process the card payments,they then have 28 days to inform you that they will not be "continuing to treat" incredibly they then have a further 60 days to refund. /forums/images/graemlins/tongue.gif
 
But their T&C's state that the card payment will be taken upon dispatch... so they can't take the payment and sit on it. They would be in breach of the contract I have formed with them.

Secondly, i'd be interested to hear what your lawyer has to say about about the e-commerce directive and its presentation in UK law.....My understanding is that under the european legislation, the e-mail confirming the order is the acceptance of my invitation to treat. The defence that this is automated doesn't carry any weight and still suggests their intention to form a contract. (as per the Kodak and Dixons case studies - both of which are well known in this space)
