There is no way that my yard will allow boats to be put ashore with main masts up for this very reason. Very few yards up my way are keen on pit props/oil drums either-its either your own cradle or hire one of theirs.

Sorry to read of your accident to your yacht, re insurance BEWARE!!! Used to be with same insurance company, I believe.
I had to claim and insurance claimed back 25% on clause for betterment. You'l find it on page 2 of their KEYFACTS. They will want 30% + for some of the items. Also you will loose your NO CLAIMS unless you stored your yacht on a MARINA,THEY RECOGNISE! Boat yards
will not be recognised by them.
You'r better to claim the yard for the damage, or the other boats.If you go to your insurance you also loose the right to do so.Do you know if the yard is a member of Federation, this can help.

In an attempt to cheer you, I have had two claims with GJW, both as in your case were patently not my fault. On both occasions they paid out with no fuss (recouping from the at fault paqrty) and though we had to pay an excess we received a further cheque for uninsured losses that they recovered for us a few weeks later and that included the return of the excess and no loss of NCB. This is the main reason why I continue to insure with them despite it being cheaper elsewhere and also why I now have my marine trades and public liability policy through their commercial arm.

Well so far I am still waiting for a result from insurers.
They had a surveyor out yesterday so its a waiting game now.

As for "cleaning boat" after looking around my boat for a while yesterday the surveyor asked me when her topsides were painted, he was surprised at the excellent condition when told it was the original gel and not paint.
I took that as a compliment.:p

Hi C_L apologies.... was not inferring it was in a state, just I know how quickly they can become grubby in winter ashore, and I suspect it may be best to have her looking 'spic n span'.

No problem mate I dident take it badly;)
As it turned out the boat was completly covered with snow when the surveyor came.

Still waiting to hear from insurance despite the fact that I would imagine the surveyor would have reported to them by now, as it was last thur when he came.
I think they are doing nothing until they get a second set of estimates which is been dealt with.
Will be two wks on thur since it happened.
While on, do the insurance just pay the repairers/riggers they decide will be used or do I have to appoint them?

If you claim through your insurance they will claim on your policy. If you don't want to do this you need to claim directly through the third parties insurance.

I know this because last year someone hit my boat whilst it was on it's home berth. I supplied all his insurance details to my insurance company expecting them to claim through the third parties insurance. I was paid out in full with no issues (GJW).
Just recently the same thing happened again, someone hit my boat whilst on it's home berth. I phoned my insurance company with the third party details and in conversation they said it wouldn't effect my premium cause I was allowed two claims a year and it was in my home marina.
I questioned why it would matter and it turns out that because I filled in the claim form from my insurance I was claiming on it.

So this time I sent the quote directly to the third parties insurance which they authorised almost immediately.

That's my experience anyway....

Too late to advice me to claim on someone elses insurance.
At first contact with my insurers I said I wanted to claim on my ins, fine they email me a claims form.
During second phone conversation they adviced me to claim directly from the other boat owners ins, that was shot down like a ton of bricks during a call to his insurers.
They then suggested I write letters stating other partie's responsibility,and copy to my insurers, I told them no as I was not personally entering into loggerheads with anyone and felt that was what I had insurance for, they accepted that.
I then told my ins that I wanted to claim on my ins and let them do the rest.
That is the way things stand at present.
I am now getting pi**ed off having not heard anything for some time now, even though they had a surveyor looking at my boat last thur or fri.:(

Out of interest, do you have the legal cover? The way I understand it, this is the kind of situation that would be dealt with by the legal cover? ie. You don't claim off your insurance, however the legal cover people claim off the other party/ies on your behalf?

An insurance company does not have any legal power to establish who is responsible for damage. In most cases they get it right, and since litigation is expensive most counterparties give in to insurance companies demands, and customers trust that they will act on their interests.

However this is not always the case and the ultimate decision rests with the Judicial System.
