Does anybody have a Beneteau Oceanis 40 CC with a black water holding tank in the aft heads? Where is the tank? How is it plumbed in? Going to Spain/Gibraltar so we need a holding tank. Or should we just get a portapotti?

There is no legal requirement to retrofit a holding tank. What legislation there is covers disposal of waste which varies from country to country and often in local areas in the same country.

There is useful information on the subject on the RYA site. Read it and then decide yourself whether you want to go to the expense of fitting one. The factory installations in that era were not necessarily the best way of doing it and it may be worth talking to Tek Tanks who have a lot of information on retrofitting systems, and may even have done one for your model boat.

Legal or not if you are planning on spending time at anchor (or a day or two on a harbour wall) it is the civilised and convenient thing to have. I don't often see anchorage with people swimming in sewage but when a boat does forget to use their holding tank it's very obvious very quickly in clear water.

The "Owners manual " for the 373 gives a fair amount of detail on the Holding Tank Plumbing, so if you can get hold of the 40 cc Manual it may be in there

Valid point - but the OP says he is going to Spain/Gibraltar so NEEDS a tank. Just pointing out that legally he does not need one to visit those territories. So it is his choice and he may choose alternate strategies for complying with waste disposal rules just as many others do, who find it difficult to fit a holding tank.

Fair enough - not intended as a criticism of your post but as a suggestion that a holding tank is a good move anyway
