The UK C&E are most definitely able to charge UK tax once you are 11.99 miles from UK, if you have stuff bought outside the EU. C&E don't enforce now because the cost of diesel in CI is pretty much same as Solent, so there aren't zillions of people filling up in CI to save UK tax. But if UK fuel is say 80p/litre and CI barge 12 miles off IoW sells it for 30p, it will be a whole new ball game and C&E will surely enforce

The only thing I was saying in my post was that - contrary to what Dom said earlier in this thread - C&E do not need to know how much untaxed diesel you have in your tanks to assess you for tax when you enter UK waters. The law expressly allows them to make best estimate and assess you based on that. The punter who disagrees the assessment can appeal it, but onus of proof is on him.

Indeed, it seems that C&E will take exactly that approach, and demand duty upon your return into UK waters. <A target="_blank" HREF=http://news.bbc.co.uk/1/hi/england/tees/3877227.stm>The BBC</A> have a report now including a quote from C&E.

That's the only thing we have had a vote about, free movement of goods, no custom's barriers. We now have everything we did not vote on, and none of what we did vote for, somewere we seem to have a minor glitch.
