I understand that from this year you will be asked (if old enough and I'm not yet) if you are living in UK in September of the year in question. That's from some reading I did on another topic so sure if it correct.

Isn't more to do as to where you live? Lotta chat on other forae about France. It can get Bl++dy cold in many areas, here included, but the Brit Gov have included the island dependancies in the Pacific in their average culcs. So we are deemed too warm to qualifie. Still, at least the oïl price has made life a little easier = warmer

Thanks to this thread, I have just appiled for my first winter fuel allowance. I did get an email but it wasn't really very clear. I thought that I had to be on benefits to get it. The only problem now is that Mrs Dipper already gets her £200 automatically and I suspect that I will be given £100 and Mrs Dipper will be asked for £100 of hers back.

It is still payable if you qualify for a UK state pension even if domiciled abroad in one of the countries where the pension is not frozen. However, the recent spat is because non residents of UK have the payment removed if they live in a country where the average winter temperature is above the minimum level. This particularly affects France as, although much of France has temperatures below the minimum, the "official" figures include the overseas departments so the country average exceeds the minimum. Cue whinges from the French resident, UK citizen DT and DM readers.

Lot of misunderstanding here.
It is paid to EU citizen who have an association with the UK (Have worked or lived in the UK for some time). It is paid at the rate of £200 per household. You qualify if you are resident in a qualifying place at the right date. To date the right place is within the EU. Originally it was not paid if you moved out of the UK before the qualifying age but this had to be changed ( and back payments made ) when the ECJ overruled the UK government.
The new amendment to the law is that if you live in a country that the DM disapproves of you won't get it.
Unfortunately this change is also against treaty agreements and so will be overturned in due course.
The implementation of this amendment will mean that for the time being I, who live in France, won't get it but someone who lives in Sicily will.
