Re: Questions On The Guadiana

We haven't been into Vila Real this year as we always anchor off or use Ayamonte, which was dredged during last winter.

Not that there was ever any need but the channel up river is now identified by a series of big posts. Something to be aware of at night or in poor visibility.
BIG posts with flashing lights that are so bright you can't see a damn thing outside the marked channel. Stops at Alcoutim, but rumour has it they intend to continue on to Pomerao whe EU gives them some more money to waste.
Total nonsense, and spoils the pleasure of anchoring.

Faro Customs Demands A UK Vessel Produces A Form T2L

I have just heard that the Customs in Faro have demanded that a British flagged cruiser produce a Form T2L (to complete a T2L you have to get and complete a Form C88, issued by HMRC) to show VAT has been paid.

Many will be aware that this problem has trundled on for a number of years but to date the numbers challenged have been low.

In the light of recent events, is it all about to change?

ps

Aware that a number of the British flagged vessels required to produce a T2L, were originally registered offshore (Channel Island, IoM etc) is there any correlation?

Isle of Man is part of the EU VAT area, so it shouldn't be an issue. CIs, of course, are not.

(But of course flag state is not the determinant of VAT liability, anyway. Where the owner, be it company or individual, is 'established' is the key factor. In most cases, but by no means all, they'll be the same.)

T2L is not intended for the purpose you describe. Maybe it's understandable that a new EU entrant like Croatia gets this wrong, but Portugal...? This evidently isn't the first time Portuguese officials have asked for T2L, including long before the brexit vote.

There was reference in another recent thread to a demand for tax in a Spanish marina "due to Brexit". The information was both garbled and second-hand, but perhaps we might expect a few such local initiatives from ill-informed officials. Surprised we haven't heard of any in Greece: they can be quite creative when not actually asleep.

Would be interested to hear boat details as we're on the mooring at Faro and have not seen or heard of any customs or police activity.

Background to this issue is at http://lagosnavigators.freeforums.org/t2l-forms-t329.html,

This morning I contacted HMRC and await their response, which I will forward on this thread.

Graham, I will PM you actual details.

Please let me have the details if it proves to be true. The OP on LN merely says - Understand a Lagos based vessel has had a challenge regarding T2Lfrom Faro customs. Which hopefully could be just another rumour.

Don't post other people's details in open forum.

Apart from that you have all of the relevant details at my disposal.

I would point out whilst it was the Faro customs that requested the T2L, the boat's location was not revealed.

Apart from Lagos, Portimao, VRdSA not aware of any other custom regions in the Algarve. As with many things in Portugal regional authorities are totally autonomous and do not confer with other regions - almost unbelievable in the computer age. Everything is recorded on paper, in triplicate and maintained in huge libraries.

Currently, I am awaiting HMRC response to my request for Form C88. They have promised to reply within 15 working days.

Lets say most of us are less likely to be bothered but, hypothetically, if one had a boat of maybe 50 ft, not very old, expensive and possibly ex charter, then it could be of interest to customs.

Which (almost) exactly fits the description of the boat pinged by the Guarda Fiscal.

Yes. I was attempting to give some details without disclosing information which would identify the owners or the boat without their permission.

It does appear there are certain details which tick the authorities boxes to instigate further enquiries. Most of us with older boats and clear paper trails have little to worry about.
