Seems to be legal but I feel cheated

I would like to thank Peter (surname withheld to protect etc) for passing a fully functioning plotter and chip over all included in the purchase of our boat, even though it wasn't on the inventory.

You sir are a gentlemen.

BUT it didn't include my sea area! Finding out at Dungeness that you had only bought the cheap Solent end version in a bit of blow wasn't nice.

Bar steward......you could have taken it after all....... Harumph!

Moral of boat buying/inventories - hope for the best but expect the worst!
 
I know the feeling. Like when we found that the engine "5 hrs since last overhaul" had one of the cylinders shot. 3,500 euros down left us feeling a bit sore. Trouble was, we had signed a standard pro forma on taking possession of the vessel that said we had, "no further claim" on the previous owner. Did you do the same? I ran it past a lawyer friend of mine who advised us just to walk away.
The question is this - would we have still bought the boat if it had been 3,500 euros more? Of course we would.
As for appealing to the better nature of the previous owner, if he's behaved like that, his better nature may be a bit lacking. I made myself feel better by putting it in my blog http://www.eclipsesailing.gr/2012/07/economical-engine/ My advice would be - grumble like hell in this forum to give vent to your anger and then go for a nice sail in her - once you've got a genoa, that is.

As everyone knows that chart cartridges are sold and priced separately to the plotter it just makes sense for the buyer to confirm whether they are included or not, if it is not specifically mentioned in the inventory.
 
Just to put this discussion into context, it's obvious that none of you have ever dealt with a vendor like someone I know.

He had bought and sold well into teens of boats, he always expects and insists upon having every thing included and in perfect order at absolute rock bottom price.

When he then becomes the vendor all rules, morals and decency are out of the door, all fenders and warps are swapped for rubbish items, and he has stocks of these, remember he has done this many times before, I honestly believe that if it possible he would remove any previously applied paint/polish.
I could go on but I think you will have got the picture.

I'm amazed what I've read here, whenever I've sold a boat/car/whatever, I've always thrown in various goodies to assist her future life.

When I bought a Carter 30 via Berthon's brokerage in 1986, I got loads of kit like opening cheek blocks, jockey pole, bucket with the bottom cut out and a bag of elastic bands, ( which caused a bit of head scratching until I realised this was for setting the spinnaker in a folded state then using sheet and guy to break the elastic bands and deploy it )...etc not actually mentioned on the inventory.

It's a sad comment on modern life if we have to itemise every line and fender !
 
The purpose of the inventory is to avoid disputes like this, if its not on the inventory, its not included. Simple. I've even seen pulpits and pushpits on the inventory.
 
But as i've said, I think twice now, the Chart Chip DOES NOT DRIVE THE NAV SYSTEM! It is software which enhances it, and it isn't mandatory!

If you bought a Raymarine Wide Plotter from me, and then turned round and said "Well, where's the chart?" I'd point out that it's available for £xxx as an extra and does not come as standard (Ok, to be fair, I would have done you a deal on both as a package!). Why there are people thinking that as soon as the equipment becomes second hand, that the chart MUST be mandatory, I just can't get my head around....

Jonic made the same point, if you go into a chandler and ask for a Demonstration of a raymarine plotter and they produce a shop chart card to demonstrate to you how it looks like with the optional chart software installed...you wouldn't be able to insist that the shop demo card is included in the sale, you could ask, you'd likely be politely refused, but you couldn't insist or legally compel them to include it....
