I had always believed that the RRS must fit within the ColRegs, even if for no better reason than that the ColRegs require any derogation "by an appropriate authority" to conform "as closely as possible", and I am unaware of any MCA derogation for racing boats.
The RYA book "Racing Rules of Sailing", RYA Publication YR1/05 shows a starboard tack yacht running free, with her bows almost touching the transom of a port tack boat, also running free. The starboard tack boat, although clear astern and implicitly overtaking is shown as the stand on vessel.
This scenario fits with my copy of Elvstrom (1993-6 rules) where the duty of a yacht clear astern to keep clear is within the Same Tack basic rules.
ColRegs are explicit in Rule 13 that "any vessel overtaking shall keep out of the way ...", and that "A vessel shall be deemed to be overtaking when coming up with another vessel from a direction more than 22.5 degrees abaft her beam..." In any doubt, the onus to keep clear rests with the apparently overtaking vessel.
It seems that under the RRS, the slower vessel must give way - which in the case of the RYA's illustration may be difficult.
There seems to be a fundamental antagonism between ColRegs and the RRS. Does this matter? I think it does where racers and non racers share the same water. It might create difficulties with insurance if there were a collision "round the cans", and its also possible that some crews who do little but race could "forget" that ColRegs apply.
