Westwater Yacht Sales Expensive Storage

I put my yacht up for sale with these Brokers in July 2002 as they offered 6 months free storage at Titchmarsh Marina.

Westwater eventually found a potential buyer but the sale fell through as they wanted me to drop the price a further £3000 after the surveys had been completed and the sale verbally agreed. This was 6 weeks after the end of the six months free period. I then changed my mind and decided to keep the yacht.

Westwater then told me that as the boat was being withdrawn from sale I had to pay over £1000 storage charges. The contract for the free storage stated that storage charges were only due if the boat was withdrawn from sale, unsold, during the 6 month free period. I disputed the charge but was told that I had to pay and Titchmarsh Marina would not launch the boat till I had paid in full! (Both companies are I believe owned by Chris Titchmarsh)

I started a claim in the Norwich County Court against Titchmarsh Marina to get the boat launched. They finally admitted they were wrong and eventually launched the boat. They continued to issue invoices for storage for the period that they refused to launch the boat and I took them to court again to get them to stop issuing these demands. The court told Titchmarsh to stop this action and to stop wasting the courts time. At both these hearings Titchmarsh was represented by their solicitors and a barrister. I represented myself.

Following this judgement, on the same day, Westwater instructed their solicitors to start a claim against me for the original disputed storage charges! This was contested at Norwich County Court again. At the hearing the Judge agreed with me that the storage was free and the case was dismissed.

If anyone knows of anybody who is using Westwater Yacht Sales I would be happy to hear from them, perhaps I can help them from being incorrectly charged for storage. I would also like to hear from anybody who has actually paid storage for the "free period" as this judgement means that they could get their money returned, and possible compensation.

Westwater Yacht Sales have issued many invoices, statements and letters demanding payment for this free storage, threatened my family and me, in writing, twice with debt collectors and have contacted committee members of my yacht club accusing me not paying mooring fees and they also contacted the local Volvo dealers telling them that I do not pay my debts!

The time and cost involved in contesting this storage invoice has been significant and I think most people wouldn't have taken them on, as Westwater and Titchmarsh marina are not short of financial resources.

Westwater and Titchmarsh are not members of any brokers or marina association although they use a photocopy of an old version of the association of yacht brokers sellers and buyers contracts. If they were I could have asked the association to arbitrate.

Brokers and Marinas should not get away with service like this.

I assume by the 2nd, and if not, then definitely by the 3rd Court appearance the legal advisers were telling the proprietor to back off and not waste his time. By implication you seriously rattled the owner of the business who seems to expect to get his way in such matters.

It’s good to know that the legal system works sometimes, well done.

Not often bothered to write posts as I am more inclined to read as a self confessed lurker however this one prompted me......

Good on you for taking them on and congrats for winning - have been miffed with service from some in the past myself and hope that stands like yours will mean one day we will get the service we deserve for our money

Thanks for responding. More than Westwater or Titchmarsh have done so far.

An apology from them when they lost their case I think would have been in order but they will not even send a credit note to cancell the incorrect invoice.

I'll add to that shame. I wish I had read the post before I dealt with him. Adrian Wright just strung me along untill I purchased flights from Australia to the UK to look at the boat. Then sold it out from under me. He refused to send me contracts to lock the boat in as sold. I think he was just hoping to get more money. I was 100% clear that I was flying over to look at the boat. And that I did not see any problem with the sale going through by the end of the week. I could not be clearer than that. Price was agreed. Deposit was agreed that I would not send untill I had the contract and that was OK by him. I think he is currently the most dishonest broker in the UK. I will be taking him to court.

From your posts and the attitude of the Broker I would make sure that your credit rating has not been adversely amended by them or the debt collection agency, there could just be a nasty there especially as there is a non-cancelled invoice/credit note outstanding; seems a devious enough firm to do that kind of thing.

I don't think they have done too much wrong in charging you initially, otherwise everyone would store a boat for the winter and list if for 3x what its worth. They have to make sure only genuine sellers (with some hope of commission) get the offer. The amount of the invoice doesn't sound too bad either.

It is illegal to menace debtors, even though in the event you were not a debtor. If this had happened to me I would seriously consider suing them for damages. You will probably find any number of solicitors prepared to work on a no-win-no-fee basis. Buy the sound of it the chances of losing with a judgment in your favour is low.

On what grounds? You obviously were not prepared to enter into a sales contract by handing over a deposit prior to viewing the vessel.

Take it on the chin and don't waste money on Court proceedings. As an Aussie bearing highly valued Aus dollars the UK will be ripe with bargains.

Hi great to see your e mail I have been trying to contact this company for a number of days as I am considering making an offer on a nelson 28 motor boat called Zest but have been unable to contact them.Thank you for informing that they do not belong to any brokerage company would make me uneasy dealing with them would like to deal with owner Direct.
But good luck with your quest to put these people away.

There are a few (or quite a few) really appalling people who run marine/boat businesses in Britain. With the libel laws that operate in the UK it's very difficult to disseminate this kind of information.

start by sending them a Notice of Intent stating if they did not launch your boat by x time you will charge them £x per day make it a good charge say £500 plus.
when they don't launch send them an invoice then take them to SCC, Any think up to £5000 is taking care of in the SCC.
