You can’t be prosecuted via a road breath tester. You can be arrested on suspicion of etc....

it’s then off to custody on the big machine or a blood test.

refuse to give a sample.....guilty.

interestingly......alcohol levels can be back dated in effect. You crash your car drunk.....walk home.....lifted 6 hours later.....breath, blood test, urine.....they can prove what your alcohol level was 6 hours ago even if you’re under now. Got to prove you where in the car and driving etc.... obviously

Which, of course, is why people have been known to (claim to) have had the odd drink on getting home to get over the shock of the RTI.
