I’m not sure an IP lawyer was the best choice!

Do you really think these exclusions represent that:

Beautiful Marine Floors does not assume responsibility for the workmanship or installation performed by the fitters.

The relationship between the customer and the fitter is independent, and any installation issues or defects arising from workmanship must be addressed directly with the fitter.



If I was trying to differentiate my offering as you suggest I would have a BML accredited fitter logo, which was licensed to approved suppliers that came with a guarantee from YOU that if the customer was not happy BML would resolve it for them - the exact opposite of what you have.

That’s exactly what your warranty says you do!

We do have a service commitment so feel we are entitled to show case fitted decks. The service brand commits to check the fitters ability and authority. Eg past work. Insurance etc. We generally don't fit decks ourselves but we commit to check installers. Our websites try and reflect the product and service we offer. Beautiful Marine Floors was successfully sued on the rare occasion of a problem even though it was not the company that fitted the deck .....because we certified the fitter and gave an arguably wrong instruction.

So the decks in the images on this page (as an example) Synthetic teak for boat decks were installed by you? Because if transparency was my mission I would have a caption on each picture which said “XYZ Product from BML installed by ABC Ltd, on [40ft Motorcruiser], 2022”

So, what you are saying is that your warranty is actually lower than the courts interpretation of the customer’s statutory rights? (I think that probably is the case). If so, why the carve outs in the warranty? Why the criticism of your competitors who would be interpreted to be similarly liable for any equivalent claims they make. Rather than waste your time here failing to promote your “cause” why not pass on the details of the lawyer who represented the pursuer in your case to the other customer and let another decking company learn its lesson the hard way?
If there is anything on our websites you feel is misleading then please e mail the company and it will be changed.
Well I would suggest the your blog from 8th Jan which says:

  3. No Recourse for Poor Workmanship: If an agent fabricates a deck incorrectly or fails to install it properly, the customer has no recourse through the brand’s warranty. This leaves customers in a vulnerable position, often with costly repairs needed.
Is misleading. It describes those things as stuff other companies do, when in fact they are exactly the things you do!
