CRA ss 11, 50, 62 are not ever capable of being breached by anyone, as matter of simple English. So that deals with those three - no cigar.

CPUTR2008 is a different bit of law - it's 2nd ary legislation made under powers contained in ECA1972, not powers in CRA2015 or its predecessor - whereas the cigar challenge explicitly in its terms relates to CRA2015. But no worries, I'll turn a blind eye to you moving the goalposts.

To remind you of the challenge, because you seem to have forgotten, it is whether CRA2015 (or, following the goalpost move, CPUTR2008) impose an obligation "marketing materials must accurately reflect what the warranty covers" (your words).

Unlike the CRA stuff, the paras you quote from CPUTR2008 impose obligations on traders so they are capable of being breached, punishable by a fine and in extremis 2 yrs prison. Whoopy-doo that means you're in with a chance! :) Alas, no cigar, because the obligations imposed do not include the obligation "marketing materials must accurately reflect what the warranty covers." If I've missed where they do, feel free to quote the precise words that I'm not seeing.

I'm kinda bored of all this, as is everyone I expect. So unless there's a significant new post, I'm checking out.

Deckfab and Beautiful Marine Floors Response to Quality and Warranty Discussion

At Deckfab, we own our own tooling and extrude decking in the Midlands. We manufacture our decks in Chichester, ensuring we have full control over the production process. Every product panel we create is assigned a unique warranty number, and every deck installed comes with a product guarantee signed by the deckmaker and personally by me. This ensures full accountability and transparency from both a product and service perspective.

For Beautiful Marine Floors (BMF), while we do not guarantee the installation itself, we do ensure that every installer we work with has been vetted, with references and previous work reviewed. We only work with qualified professionals who are capable of delivering the high standards our customers expect. We stand behind the quality of the installers we recommend, and we check that they meet our strict criteria.

We have made hundreds of decks over the years for many materials suppliers, and we pride ourselves on being transparent with our customers. We welcome feedback and are always looking to improve. We currently have 2 bad service-related reviews on Trustpilot, thats all both of which we’ve learned from:

The first review was from a customer who was unhappy with us removing plastic film from the deck before installation. Although we acted in the best interest of the deck and the customer, we lost a court case on a technicality because we didn’t obtain explicit permission to remove the plastic film. We’ve learned that, going forward, we need to ensure customers give us permission for such actions in advance.

The second review concerned two decks, both of which passed the “fit to install” inspection by the customer before installation. The customer later wanted to change the deck after installation and also handled the deck in a way that we did not recommend, including using a belt sander. We’ve taken this feedback to heart and improved our process.

We also recognise that there have been product problems with other brands in the market, and some of these issues have been well-publicised. In some cases, we’ve replaced decks from other manufacturers. We understand that such issues can cause concern, and we strive to avoid similar situations by being fully transparent about our guarantees.

We believe our customers are very savvy and well-informed, and we take great pride in offering both product and service guarantees for every aspect of our work. From the material to the product itself, and through to the installers we work with, we ensure transparency and accountability at every step.

This industry is competitive, and while we haven’t directly promoted Beautiful Marine Floors (BMF) in this discussion, we’ve aimed to clarify the matter of warranties and the importance of transparency. As a small company, we are eager to scale while maintaining our core principles of quality, trust, and transparency.

Your support in helping us grow our network of BMF installers and expanding our customer base would be invaluable. With more customers, we can train additional deckmakers, continue to maintain high standards, and keep the process open and transparent.

It’s important to note that there are broader concerns regarding consumer rights and trading standards in the decking industry. Some companies in the market have received criticism for their marketing practices, particularly the representation of fitted decks and warranty information on their websites. When companies showcase images of multi-million-pound boats with fitted decks, there’s potential confusion about what exactly is covered by their warranties.

The Consumer Rights Act (CRA) requires that marketing material accurately reflects the nature of the product being sold. If companies market fitted decks without clearly stating that they do not directly offer installation services or warranties for those fitted decks, they may be misrepresenting their products. This could lead to legal challenges, especially if consumers feel misled about the level of warranty coverage or the services provided.

At BMF, we understand how crucial it is to be transparent about the scope of our warranties, the nature of the products, and the role of our agents and installers. We stand by our commitment to ensure that both product and service guarantees are clear and honoured.

Victor - this is all waffle and personal opinion without a shred of evidence in support. I have no idea what you think you might achieve by posting it here. As you can see from the responses all you have done is demonstrate you have no understanding of the law in relation to consumer rights. Your experience with the courts should surely have taught you that the way to avoid problems in business is to do things properly.

This forum is for boat owners to share their experiences about boats,, equipment and boating in general, not a platform for traders in the industry to promote their products and slag off competitors.

Definitely not a good way to make friends in the boating community.

Our team has a long history of manufacturing quality decks, including for Tek-Dek in the past. In fact, the director of Tek-Dek was trained by us, which demonstrates our expertise in this field
Your Trustpilot feedback does not seem to support this. In one year 4 responses of which two lead to long expensive court cases about how you support your "quality" work - both of which you lost. To make matters worse you did not respect the court's findings until forced to.

I imagine the deck is still in use and performing well. The claim was originally against the fitting company, but Beautiful Marine Floors had to pay out because I instructed the fitter to remove a protective film without explicit customer permission. We fought the case, which unfortunately made things look worse. Attempts were made to contact the customer for approval, but we were unsuccessful. Since then, we've tightened our processes to prevent similar issues
