Hit by Sunsail yacht, Am I being unreasonable?

He thinks he is an ex mayor /forums/images/graemlins/smile.gif He lost last Octobers election (by a large margin)
It remains to been seen what the new one will do. Dont hold your breath!

We first went with Sailing Holidays and had a great time. I tried booking a flotilla hotel holiday as I had only sailed a Dinghy. The owner explained that they did not bother with 1 week ashore learning to sail anymore and after asking about my experience said he would be happy to charter me a 36' boat.

I was surprised but he insisted that with Dinghy experience we would be taught how to anchor/ start engine/ berth etc and if I was not confident he would leave a skipper on board for the first few days but he considered that we would be cautious and manage OK. He added that it was the Commodores of YC and people who thought they knew it all that caused damage to his boats. We were cautious, we did manage on our own and had a great time. 2 boats got into difficulties one an experienced big boat skipper from my YC who had the back stay go when caught suddenly with a F9 in Lefkas Bay and a YC Commodore who went aground!

Were they right to let such inexperienced people have a go? I am not sure but we loved it and promised to then get our own big boat!

I can hardly criticise Sunsail if they do the same but they do seem to have more unfortunate incidents - whether that is a function of their size I don't know.

Steve, the Mayor covers the area called Pylaros valley, this streches from Agia Efimia in the east, across to Myrtos beach in the west, the taverna on Myryos beach is owned by Agia Efimia (Pylaros) council, and raises revenue for the region.
Last year the mayor you reffered to was called Makis, he lost the election in October 2006 and was replaced by the current mayor Markus.
Each region of Kefalonia and Ithaki has a mayor, plus there is a mayor who controls the whole prefecture (Kefallinia) It seems to work most of the time!

I am pleased you enjoyed yourselves, thats what its all about. I think the flottilla holidays are a good way of gaining experience plus introducing friends to sailing in warmer tideless waters. I have no problem with anyone wishing to charter and learn. Everyone makes a mistake, no one is perfect, I would simply have wished that the persons who hit me, would have owned up.

The area around the northern tip of Ithaki to Lefkas can be very bad at times!
Maybe not to an experianced crew but, I have seen the faces of newbies in 27ft Jags when they have thankfully reached Fiskardo!
When the wind blows from the northwest 5/6 the seas across this stretch are short and steep, it is only when you are in the lee of north kefalonia does it decrease.
The best times to cross are early morning or in the evening.

If you can get the damage fixed for £100 then, if I were you, I'd just do it and forget about it. Of course it's annoying when people don't own up but life's too short to insist on your rights all the time.

Yes you are probably right! It was never really about money as it was such a small amount. I suppose I consider myself to be an honest person and have met a lot of nice folks who sail or motor, so it annoyed me that someone would do this who shares the same interest as myself.

I forgot to add, Sunsail say they have contacted the charterers, they have denied the incident took place. Sunsail are asking for stamped complaint forms from the port authority, port authority say none are needed and they will report Sunsail to the port police if I get no joy, It means me dragging witnesses away from their work all for the sake of a few quid.
I am awaiting another e-mail from Sunsail.

I regret to hear of your report of damaged to your auxiliary engine. We were unable to question any of the people who had hired the yacht for that period as they had already returned the yacht to us and had not reported any ‘incident’ during their debrief. Subsequently we have not been able to contact them.

We do not have any representatives on Cephalonia Island and so are unable to see the damage for ourselves.

We do certainly always encourage ‘good seamanship’ and ‘manners’ in any way that we can with our charter’ers and can not condone any irresponsible behaviour.

Madam,

Your letter of xx provides no solution to the loss I have verifiably sustained at the hands of one of your charter parties in xxx on xxx. We intend to press for full restoration and recovery of all losses and costs - repeat details attached. Since you no doubt have a number of similar incidents every season we anticipate you have established procedures and conditions of charter to cover such matters, and insurance.

Naturally we expect a company of your standing to make good these losses without recourse to suggestions that not having a representative on site excludes you from taking the matter seriously.

The names and addresses of all on board the chartered vessel on that day will be known to you, and whether you are able or willing to pursue the charter parties for recovery of this claim is your decision - we hold your company responsible for our loss.

In the event you are unwilling to settle our claim, we reserve the right to other measures.

Faithfully, etc

Conditional on providing good photographic and witness evidence, I would expect you to receive an immediate settlement offer of 50% of your claim, which on pressing will be raised to no more than 75%. Of course a decent company would settle a reasonable claim 100% but the nature of the letter you have received suggests their practices are tainted.

Most people buy the damage waiver anyway. So why run away, esp as witnesses?

We had our rubbing strake and transom crunched 3 years ago- and it had to be someone nearby on our old pontoon- but no note or apology ever materialised. Thats worse, it's someone you see & speak to.
 
This is what you need to do

Inform the Greek Port Police of the incident and give them full details of the YACHT that hit you and the damage they caused.

Tell them its a "hit and run"

They WILL impound the vessel where ever they find it and prevent it from moving until the matter is settled - and they DO go to great lengths to find these culprits (vessels); they wont care who is on board - its the boat they will be after.

So even if the boat is under a new skipper he wont be able to move until sunsail have sorted it out.

THAT is exactly what has happened this week to a boat here in the Ionian, the boat was found and arrested 60 miles from the site of the accident.
Do you really think they will be that interested in something that happened more than 3 years ago?
