I think matthew's buying a Targa 35 (in which case a 10% deposit is a decent chunka change, not the sort of money you would want to lose by a badly worded contract)

Absolutely right, it's a Targa 35 and it's a lotta dosh as far as I'm concerned.

I haven't already paid the deposit as I would not do so until I was comfortable with the paperwork. So, I've taken a standard Agreement for the Sale and Purchase of a Secondhand Vessel and used the appropriate/relevant clauses as the basis for an agreement which protects me (and the vendor).

In summary it says, in legal language, I want your boat, I'll pay a deposit, if the sea trial and survey are OK I'll buy it, if it isn't as it should be, I'll reject it and you'll give me my deposit back.

Nothing too demanding, just fair, written in legal speak and bridges the divide between trust, clarity and legal protection for all concerned.

Thanks again for all your input - I'll let you know how it goes.

i wonder if any actual cash is involved?? If so - i have just been looking at some £20 notes and they simply say " i promise to pay the bearer etc etc" which doesn't sound very watertight at all! Worse - it's a just *photocopied* signature which makes it pretty dodgy in my book AND the person calling themselves the Chief cashier has left the Bank of England ages ago!

Matthew, that makes good sense. Just one extra point - make sure it says the broker holds the deposit as stakeholder and not as agent. This makes a big difference to your rights and to the strength of your argument if things go wrong. Most agreeemnts used by reputable brokers say stakeholder not agent, so this is quite normal.

Hi Ian,

Are you back down on the coast again now after wintering on the Thames?
Hopefully we'll be able to keep up with you now we're gonna be in something a bit bigger and quicker than last season.

All being well we'll be in the water in just a few weeks. It's painful paying for an empty berth!
