Failed survey

Having surveyed two S34's recently and looking at countless others you will never find something that is perfect - after all they are getting on in age a little now.

The first 34 I surveyed (formerly Shark Bay) is in need of sumps too. I knew this from my inspection but gambled on a survey expecting to get them repaired etc. as part of the deal. There were too many other things wrong so I walked.

However I spoke to a few Volvo mechanics and dealers - the dealer will tell you the engines need to come out - the trusted mechanics say otherwise. Still the sumps are about £700 each or more so not cheap.

If you can get a good deal go for it. The next one might be as bad.

Currently sat on the S34 we ended up buying - the starboard engine is stuck in gear with a EDC fault and I had to buy a new canopy because the original leaked like a sieve. Neither were issues at the time of survey.
 
Me too. Instead of writing a load of bollox it might have been simpler for Porto to say "Despite the unsigned contract, I would hope the broker would do the decent thing and return Russ's deposit".

Quite and why doesn't he write deposit rather than depo it is only a sit shorter :)

I just bought two sump gaskets which alone were £147 from RK. They were just leaking but they said the main risk was a bolt sheering in which case it would be engine out. Fortunately that did not happen. I know others on here have done it, whilst up for most things I would baulk at taking engines out!

Update.

Broker is returning my deposit. Although he said it will take 5 days, where as I sent it in two hours.
He said its a shame that I couldn't wait 5 days and the boat would be repaired by then. That didn't include the sump pans though.
So I believe that we would still be at odds as to what would be included in the repairs and how well they would have been completed.

The sale pending notice has been removed and he has a viewing on it this Saturday. The advert still says one owner from new and not the four as shown in service history!

So the search continues. Thanks for all your comments.

Good news; be even better when the money actually shows up. (I agree with you about the five days thing, that's nonsense, he could just pay it using FPS, same as you did when you paid him).

Reading this tells me the broker is very good at writing his own contract in order to capitalise on the trusting buyer who may look at this boat through rose tinted glasses .
He also knows all the mechanical faults yet will not tell any perspective buyer the truth , which I’m sure in law is called plain and simply misrepresentation, plus the amount of owners .

This post is just sadly another tale of woe all about how badly the marine industry is conducted .
Over the many years this forum has been running there have been many posts like this , there will be more I am sure without some sort of legislation it will continue .
These small brokers sometimes do not play fair going the extra mile to attain a deal on a boat that has many faults , it’s time for a change .
No one can compare boat sales to buying a car but your more protected with a back street bodge artist selling a second hand banger than a 100k used 10 year old boat .

Time to move on and be wiser next time Russ I bet you have learned a lot over the last week , one thing for sure the small amount you paid for the engine survey saved you even more not continuing to lifts, sea trials and the hull survey.

Ref the work done in 5 days, the broker has no idea behind the protocol of works carried out , what would be the point in taking drives off for service, draining water and oil, changing filters etc , all to be dismantled again later to change the sump pans .
You would still have a ticking time bomb waiting for the oil to eventually leak out the sumps possibly writing off your engine in the process.

Great advise........Not.

That sounds promising, I hope the money turns up soon.

To be honest, I suspect that if you'd proceeded you'd have had more grief.

In future, I'd strongly advise you to check all the paperwork is in order before handing over a penny. I've heard too many tales of a buyer becoming emotionally and financially committed to a boat before the broker admits that the paperwork can't be found.

It's also worth taking a responsible adult with you to view a boat (I couldn't find one to had to drag Whitelighter along) :).

I'm not quite sure where the woe is or where the legislation is needed. Chap looked at a boat privately for sale through a broker, decided to proceed subject to survey, placed a deposit, had his survey, didn't like what he found regarding potential engine issues, chose to pull out rather than renegotiate (his right), is having his deposit returned.

Sounds like the broker jumped the gun a bit allowing the survey to go ahead before getting all the paperwork signed and a bit naive about what he's been told by the owner, but it's hardly a tale of woe surely?

What do you feel needs legislating?

The fact that the condition of the boat is now known by the seller and his agent yet there is no disclosure of its condition to any new potential purchaser , the fact that Russ was informed it was a one owner boat yet it turns out it has had more than one owner , the standard YDSA or RYA contract was not used , there were areas on the purchase agreement that did not match the boats location , areas not signed prior to deposit being paid , to me it seems the agent was far more interested in cash in his bank prior to preparing the correct paperwork to enable a positive sales agreement between both parties .

A suggestion - give James Barke a call at boats.co.uk - he has boats coming in all the time and might have something that he is taking in part exchange that will fit your requirements and budget. He has always worked out a deal for all the 7 boats I have had from him. All the paperwork from him is always in order.

Only problem is that my wife takes my wallet off me when I go to see him!

+1 - they are simple and realistic to deal with.

Shame the port cabin has gone in favour of a new building. The Del Boy bit was fun when signing a contract for a daft amount of money !
