Col regs - who is at fault

In Colreg terms the yacht was the give way vessel, trying to overtake in thos circumstances,.very silly way to behave anyway
 
Was the yacht trying to over take or was the power boat failing to keep clear after over taking the yacht?

The video doesn't start early enough for us to know.
 
It's probably best to volunteer to be last out.

I did that. The fishing boat opposite us kicked in the power, bounced off the wall and prop walked sideways into us going slowly ahead. He then put on some astern, which was really unnecessary as his massed scallop hooks were already firmly attached to our liferaft and guardrails, then applied a LOT more astern revs. He had no fenders, and burst ours. Insurance claim was over £5,000.

Now I make sure I get the hell out before the fishing boats start to move.
 
Strictly speaking the boat was "Not Under command" but without displaying the correct shapes..... as far as the Col regs are concerned not much you can argue about with a concrete wall, who is the boat owner going to blame the Port authorities for "poor positioning" of a concrete wall or perhaps bad design? :-))

I thought that would rally up comment :-) maybe its just me then but I usually refer to people who have need less collisions as having moments of being "Not in Command" to others viewing the boat, "not under command". NUC, would be a passing joke at the bar watching this video, Strictly speaking :-))

Quite a lot of contact between the two boats prior to the yacht hitting the wall. Can't say who's at fault from what's shown, but the yacht seemed to have more opportunity to take evasive action by dropping astern of the fishing boat.
 
Not sure that it is collregs, but since I go in and out of a lock everytime I use the boat, everyone seems to know that you exit in the order that you entered. On occasion, the lie of the boats might mean it is easier for that order to change, but then you just agree with the opposite boat.Given we also have fishing boats and they dont seem to mind bumping into thimgs, everyone checks what they intend to do.
Seems to me the sailing boat skipper was either not thinking or wasnt paying attention.
