Boat for sale scam ?

Not sure what to think about this so I best ask for the forums advice.

My boat is for sale here (or maybe not)

The Picture is of my family enjoying our boat off France.

The advert is nothing to do with me at all and does not include any of my contact details , the price is 20 000 to 40 000 Euro less than other similar boats for sale.

This could be a scam and the boat for sale may not even exist, or it could just be a case that someone has used my photo ( I have posted it on this site a few times).

I sent an email to the guy asking him to remove the photo and I offered to send him anther action shot of my boat but without me in it, he has not replied and he has not removed the photo.

Would you bother about it ?
If it turns out to be a scam then I would feel partly responsible having not done any thing about it.


I have reported this to the site administrator who has not done anything.
I have asked the owner to remove the photo and I have offered an alternative action shot without me in it.

I was thinking about asking a few mates to ask the owner a few tyre kicker questions questions

last serviced
does it have a drinks fridge upstairs , you know the usual dribble the duck eggs ask.
Then after a few days and he has gone to the trouble to reply to a dozen or so emails ask him why the photo is not of his boat .
What do you think, just typical daka getting upset about nothing or do I have the right to be annoyed this time ?
If I am wrong please let me know and do not email him , if you feel like helping me combat a possible scam then perhaps you can email him and post your chosen tyre kicker question so we can see who has the daftest one ?

this site is renowned for having scam adverts, you might finish in some trouble if this is a scam advert
nothing is better to Yachtworld or Mondialbroker when it comes to look for boats IMO
 
Just what are you concerned about?

Neither you nor your boat is identifiable from the picture - so there is no way you can be at risk directly from the picture or be liable in any way for its use.

It may well be a scam but in that case you have done your bit by emailing the site admins, it is up to them whether they take action or not.

Your only real recourse would be as the copyright holder of the original photograph, rather than as the owner of the boat or a subject in the picture. You could ask the site to remove the picture as it breached your copyright, but if they don't it is really not feasible to enforce it.
 
If, if, if someone is pretending to be you and pretending to sell your boat, and a punter buys it from 'you', hands over the money to the 'broker' and then can't collect 'his' boat, what then ?

I'd press the 'broker' to remove the pics ASAP.

Maybe it's worth claiming to be a punter and try to get the 'owner's' details.
 
I wouldn't worry. Chances are they're selling a p360 and needed a pic, and the actual boat for sale is in the yard, dirty or something else unphotogenic. If you google image princess 360 yours comes up on the first page and the only one above 100kb, and it's a nice pic, so they just nicked the pic. No big deal. Take it as flattery! Happens lots!

If they are trying to scam someone, then you might just get caught up in it. I would simply write to your local police station giving your full details, tell them your concern and send recorded delivery.

At a later date if anything happens you can say "I informed my local police, and they failed to take action, what else could I have done". I think you'll have done everything "in your power" and "what a reasonable person could have been expected to do" and you should be completely in the clear.

Not sure what your getting excited about, the Ad is a boat in Spain, Daka in the UK, MBM and MBY is full of photos of boats for sale that aren't the actual boats.

Quite, MBY and the whole brokerage world. There's nowt to worry about. The ad even says the for-sale boat is in Sant Carles marina in Spain and has different engines from the good ship Felix. Someone has just google imaged to get a pic, as we all do. Blimey, writing to the police...

Thanks for all replies, I was a bit shocked to see my boat for sale especially as I have my own web site http://www.icvideo.co.uk/felix.html ( although not actively advertising until the market settles down) .
I was a little concerned that anyone looking for a Princess 360 would come across the same photo and may be put off due to conflicting information or perhaps not even bother to read my advert thinking it is the same as the one they have just read about that many would consider under powered due to smaller engines and who knows what sort of condition.

Just to be on the safe side I will send another email to the administrators making it clear I have no connections and that it could be a scam.

Tell them your fee for using your action shot is, :D

£1000 helecopter hire,
£400 Photographers time
£150 Expenses

So that's £1550, or maybe you will take £1k for cash ;)
