With all the hundreds or possibly thousands of Bavarias being used as school and charter boats (especially 36s and 37s), I think any fundamental flaw would have shown up long before now. This leaves the OP with either a one-off defect or accidental damage. My own feeling is that in either case the best course of action is to pass it on to his insurance company. He can then press them to get the boat repaired asap, and leave it to them to decide whether to pursue the litigation route. An insurance company would have far better knowledge and resources with which to decide whether to pick a fight or not.
