The 'stand on' vessel never has the 'right of way'. If there is a risk of collision, the stand on vessel should change course to avoid such a collision. Remember, the 'give way' vessel's skipper may be an idiot.

I hate to be that guy but when there is a risk of collision is precisely when you are obliged to stand on and not alter course (or speed). You would be permitted to alter course either: before the risk of collision develops, once it becomes apparent that the give way vessel is not taking avoiding action, or once avoiding action by the give way vessel alone would not be sufficient to avoid collision (my paraphrasing of Rule 17).

Perhaps I should have said 'If there is an fairly imminent risk of collision.'
