When someone uses photos of your boat for their commercial gain

Please get some more boats listed, one of my simple pleasures is a trip to yachtsnet and there's been very little added lately.
No one does brokerage listing as well as you do.

Please ask us to list some more boats! The numbers we have for sale have been steadily decreasing as boats sell, without enough more coming up for sale.

Bump - tidy boat for sale? List it on Yachtsnet, give me and many other boat owners the pleasure of browsing the best brokerage site in the UK. Plus you get to sell your boat :D

1) did you take the photo
2) What Licence is your flickr listed under

And 3) what is your intention is it to have the image removed or recieve monetary compensation for your work which would need to be declared as income.

There are alot of people with cameras out there who are quite "flattered" to see there photos used and those requests you get on your local news channel to send in your sunset or news pictures are just that and one of the reasons i no longer bother sending any news pics to my local paper.

As a professional photographer I have outlets that sell my images and I have to be careful where I post them e.g. twitter is a no no as anything posted on there is free for news outlets to grab

Flickr has specific licences that you can assign to your images so check that out there is no small print on flickr rights reserved is restricted creative commons is available for web use and may be searched and used for non profit
There are a couple of others but those two will be the main ones.

Google images is a pain as lots of people thimk they are free for use.

Ps if your gonma bother listing a multi thousand pound boat get bloody good pictures to go with it and if that means hiring a marine specialist Photographer then go with it. Itll pay dividends

I don't want to appear to be a bit arsey, but you've obviously not read the thread properly or followed the links.

1. Yes, answered above.
2. Doesn't matter. My boat (with very clear name on boom) was being advertised as a sailing school boat that a company has access to. It's not.
3. Image removed. Which I am told is the case, but their server is down as I write this.

I don't think your point about being flattered is relevant. To have a sailing school claim that my boat is available in their fleet is just plain wrong, regardless of the licence under which the photo was published. And by the way, I'll wager they didn't pay Flickr for the photo either.

As someone with a few different business interests we always pay for images we use on our websites, either by hiring a designer for new graphics, or by buying the appropriate licence from istockphoto. I believe in IPR and expect others to do the same, which they're legally obliged to do.

ETA: I suspect you weren't suggesting that I would be 'flattered' but it still doesn't account for having my boat on their website as an item available for hire, basically.

2) Yes it is very relevant...having looked at the website the title and description clearly states the vessel is Nicholson 43 "winsome" if that is your boat then that is misrepresentation. however if they have used a picture of a nicholson 43 that you have posted on flickr under creative commons licence then they have done nothing wrong as that is the whole point of it. A quick google search produced the following

"A Creative Commons (CC) license is one of several public copyright licenses that enable the free distribution of an otherwise copyrighted work. A CC license is used when an author wants to give people the right to share, use, and build upon a work that they have created."

I expect this website was created by a design agency who have never laid eyes on "winsome" so their first port of call would be flickr creative commons because its free usage.


My next point simply highlights the need for photographers to protect their work whether that involves checking what licence your photos are under on flickr or being careful where you share images as some social media sites for example twitter have clauses that any image shared can be used by its partners etc hence you will find alot of news images come courtesy of twitter free of charge and totally legal.

Nobody pays flickr it is not an photo agency!

using creative commons licence images is perfectly legal. tho there can be restrictions on usage such as "credit must be given" but this must be written clearly in the description and adhered to by the end user

It matters an awful lot - if it was a Creative Commons licence with no restrictions on use, then they are perfectly entitled to use that photo to sell things.
 
My old boat often used to appear in Scottish Calendars and my current boat became famous a few years ago in the advert shown in Scotland re. digital TV which showed a van running along Loch Duich and up by Eilean Donan Castle(not that anyone would have noticed)
Many years ago I was on my old boat in Rothesay harbour when a helicopter flew over very low.
The following year I appeared on "Scotland from the air"
Unfortunately copyright on line is somewhat spurious as once you put the pic out there its seen as public property whether of your boat or of you showing off what you are made of!

You have no copyright on pictures of you (in public places) only pictures you have taken. You just have to swallow pictures taken by tv or helicopters with you in the background...
 
I must say if I was the OP I'd be miffed by the use of one of my photo's, but downright fuming if someone made out my boat - identifiable as in this case - was available as a sailing school boat !
 
Have to say and I have seen the page in question I donr think they made anything out the Nicolson 43 is named as "Winsom" in both the title and description. unless that is the name of the owners boat then they have used a picture of another Nicolson 42 to show what winsom looks like. Using an image from flickr that may or may not have been creative commons.

Remember this site was probably designed by a web company that haven't actually seen "Winsom" in the grp flesh.

Probably could of been a bit more clever and removed the name.

Of course I am only seeing this page post picture takedown so perhaps I am missing something
