Is this link from a Sp pov within the comity laws. Makes sense , You know sunsail charter etc or you fancy a day hire in Porto Banus etc ….that kinda thing ..Or you are genuinely passing through.They haven’t bitten the hand that feeds them .

What about if you stay in Sp waters over 6/12 or permanently berth there for ever ? Now U.K. is a 3 P ?

The OP says he’s gonna move there so presume comity after 6/12 does not apply and under international law will have to adopt what ever the locals have / do ?

I know covids been a distraction and Russian gas dependence + the Ukrainian question = occupied agendas in Brussels.- rightly so .Not disputing this .

But some time some ones gonna put this 3 P boaty ( none member state ) qualifications stuff on a agenda in Brussels .

As said they already have the existing comity laws ….they just not yet applying them to Brits with only ICC s who over stay 6/12 .

Your link agrees that Spain is not a signatory of the ICC treaty and therefore, not bound by it.

The RYA Brexit webinar made it clear that Commercial Certificates had been covered by Freedom of Movement labour laws, and it was now up to each individual state as to whether the certificates would still be accepted. There's a table of what economic sectors can work in what country in the withdrawal agreement.

Evidence of competence (updated June 2021)
The skipper of the vessel is required to have evidence of competence and it is not uncommon for the Spanish Authorities to inspect it.

Since 1 January 2021, the UK has been treated as a third country by EU Member States. This changed how certificates demonstrating competence for recreational boating are accepted in Spanish legislation.

UK certificates should still be acceptable if a British Citizen is operating a UK flagged vessel. Although Spain has not adopted UNECE Resolution 40, the ICC is recommended for British Citizens operating UK flagged vessels.

If somebody is operating a foreign flagged pleasure boat in Spain and they are not a citizen of the flag state, they are required to have the certificate required by their country of residence or the country of which they are a citizen.

Until the end of 2020, the acceptance UK certificates for the operation of Spanish flagged pleasure boats was based on the UK being an EU Member State. Acceptance on that basis ceased from 1 January. In order to be recognised by Spain for the operation (including bareboat charter) of Spanish flagged pleasure boats, RYA certificates needed to be listed in Annex IX of the Royal Decree 875/2014 regulating nautical qualifications for the operation of pleasure boats.

Royal Decree 339/2021 regulating the safety equipment and pollution prevention of recreational craft was published on 19 May 2021 (in force on 1 July 2021). Crucially this also amends Annex IX of Royal Decree 875/2014, to include the following RYA practical certificates:

Royal Decree 875/2014 refers to Annex IX specifically in relation to the hire of Spanish flagged pleasure boats. These certificates may not be accepted in other scenarios. Professional RYA certificates that were previously accepted in Spain when the UK was an EU Member State may still not be acceptable for commercial activities in Spain. If we receive further information it will be added here.


I'm not sure what you mean by "being a signatory of ICC" but Spain appear to updated their legislation to make ICC acceptable, at least for hiring Spanish flagged vessels.
