It only asks for small claims track stuff. No dispute on a boat worth worrying about, least of all magnum's and gludy's, is in the small claims limit of £5000. Also, even if a boat claim were somehow within the £5k, or £15k as is the proposed new limit, they will usually be too complex for SCT and so be bounced to the non small claims track either by the judge or, tactically, by the plaintiff. So it was a bit of a daft request imho

Not arguing now, more thinking out aloud if I may........

There are lots of petty disputes currently ongoing for example outdrive hoses and wrecked drive pumps with manufacturers.

To an individual the amount at stake is £3-£4k but to the manufacturer the amount at stake is £100 000s and I have reports of bullying tack ticks from one manufacturer in that they combat small claims court actions with £10 000s of pounds worth of legal costs saying that they can prove the claim is totally without foundation.
As such the poor guy with a 2-6 year old boat skulks away with their tail between their legs and frightened.

This is just the sort of backing that may force some in the marine industry to accept their responsibilities.


Now before anyone jumps on me for having a go at any one manufacturer please dont, although there is an ongoing situation now we all know in the past other manufacturers have equally brought out products not fit for purpose or good products with teething issues and left us the consumer to sort the mess out while they just wash their hands and launch mark II, III, IV etc.

Not having been there, I dont know, but I suspect £5k is enough of an unhappiness for plenty of people, JFM? Maybe you meant a claim of under £5k isnt going to make very interesting TV ! Probably too right on that.
BTW, did you find a copy of an escrow document..? Not that I need one, but I thought it might be educational for those interested in the topic to have an idea of what it entails....

Well yup, true. Thing is, <£5k claims make dull TV partly becuase small items are always less interesting than big Gludies. But also claims get bounced out of the small claims track (either by the judge or one of the parties acing tactically) if they're complex and that's a second reason why they will make dull TV.

I have that escrow document - just found it. i need to edit it a bit to remove personal stuff and make it more use as a generic doc. I need 30mins to do that which I don't have today/tomorrow (I wont even have time for spot-the-boat tomorrow!) so will try to find time over the weekend
