That has been around for some time and there are questions about the veracity of the information as well as relevance to UK boaters visiting Portugal. From the information given it was an EU VAT paid boat and if that is true it is in free circulation within the EU (and can leave and return freely using the RGR rule) without any further payment. The nationality or residency of the owner(s) is irrelevant. So under EU law customs have no right to charge VAT.

Hopefully the owners lawyer is familiar with EU law and is challenging customs all the way to the Commission.

The situation as reported is not relevant to UK boat owners with a IK VAT paid boat visiting Portugal as they are subject to a different set of rules and can stay in Portugal for up to 18 months without paying VAT

These sort of stupid and vengeful actions will simply make people avoid going there in future. Portugal will be the net loser.

No one I know here in Portugal has been asked to prove anything about vat yet as a result of the Brexit. There was the brief requirement for a T2L several years ago but that was easily circumvented by contacting UK vat man and getting a T2L sent to you. In 20 years the only request I've had to prove vat paid status was by the new owner when I sold my boat and it was being transferred to Portuguese ownership. He took the vat receipt with him to the registration meeting but was not even asked to show it, and this was after Brexit. The article above was knocking around months ago and debated on here at length. IMHO I suspect there were more complications and things going on than were mentioned in the article.

Nothing to do with vengeful actions but more to do with scaremongering journalists. The boat was owned by a NZ company which in turn was owned by a Portuguese resident. The boat was VAT paid in Malta so has free circulation within the EU. There is more to this than meets the eye and is nothing to do with UK boat owners visiting Portugal.

I think the words Company and Malta says it all..... I do wish that rag Mag would make some efforts in checking things before they publish - its not the first with a totally erroneous article on the Greek treatment of UK yachts earlier this year. It added to the already confusing situation pedalled by Facebook - and it in effect confused all the Customs and Port Police who had got it right - who then started doubting when everyone was telling them they were wrong! when they were not!
