I think using another boats' photo without saying so is pretty poor; if I was a buyer who travelled a long way to find a boat nothing like the condition of the one in the photo I'd be more than a little miffed; wonder if it contravenes the sale of goods act or something ?

I wouldn't be that keen on someone using a photo of my boat either.

If it were me, which it isn't obviously, I would be profoundly embarrassed at trying to explain why the boat I am about to show someone is not the one advertised!

EDIT:
The advert should really say:
"Similar boat, image used without permission" beside the pic.

I would be flattered.

I have seen a website that deliberately takes lots of photos, and then trolls the Internet to look for people who have used them without permission, and then sues them. For a living!
I can't remember the website.

I think it was mentioned on his forum about two years ago.

I am pretty sure that some yacht clubs have been caught out using arial shots of their waters in this way.
 
I remember being a bit dissapointed when I went to see a boat which the broker had advertised using a picture marked as "library picture". The boat was beside the brokerage and I could see no good reason why they could not have taken some photos of the actual boat. I was not experienced in boat purchasing ways (current boat purchased by my family in 1935) and felt a bit cheated. Did not buy boat.
