I think the EU Citizen on or owning an no EU vessel is a tad of a red herring.

For what it's worth, when I lived in France I had a UK registered car which spent most of its life in Britain. A 'flying customs' team stopped me driving it in France and fined me 5000 francs. This was after the single union and they weren't entitled to do so. When I put this point to them they replied I should pay the fine then take up the arguement afterwards, otherwise they would impound the car. So guess what I did? I paid the fine and then tried to get the money back. Not a chance, uless I hired a lawyer at the cost of several thousand quid.

I have no idea whether EU law permits UK residents to sail Jersey registered boats in French waters. Like you I expect it does. But this won't help much with a customs officer who has taken against you or our correspondent. So my advice to anyone who wants to do it is to make sure their paperwork is perfect. The slightest imperfection and the douanes will want certified vat receipts for the boat and everything in it, no doubt including the paint on the sides and the food in the fridge. And yes, food does carry vat in France.

By the way, if French customs seem unreasonable to you I suggest you avoid Greece altogether.

I wouldn't do it until I'd talked to someone who's really clear on what you need - for example the dealer Mike M pointed towards who apparently specialises in it. I would especially want to have the VAT situation clear and I would want to be able to provide documentary evidence about everything. My advice on this is don't take advice (!) from here or from some bloke you met on the quayside.

Been playing with boats since my teens.

I find any offical tends to react to the attitude of the person they happen to be talking to.
Have the wrong attitude and you will cop for it.
Have the right one and you can get away with all kinds of stuff.

As long as your boat has the relevant RSA Ship Radio Licence you will have no problems.

This is of course the reason why there are one or two people "on here" who are exactly the people who you should go to for advice (because its their jobs!) but a lot of questions you do need to go elsewhere.

Very sorry to see that you will be leaving OFCOM /forums/images/graemlins/frown.gif. Since you mentioned, some time ago, that you were being gagged from using the "official channels" to correspond with these forums I have always felt that your openness and honesty would not fit in with the desires of the Whitehall Mandarins or, even more so, this government.

On the subject of unlicensed listening, I have always understood that one can listen in but must must not make use of any information you may receive (Police, Fire, Ambulance, etc).

This is why it is illegal, for example, for loss adjusters to listen to the Fire Brigade radio and chase the fire appliance to the incident. The same applies to lawyers following ambulance calls.

There was a famous case of an insurance assessor, Leopold Harris, who listened in to London Fire Brigade messages, charged along to the site of the fires and then represented the victim of the fire. He got to the fire before the fire engine. He could not be charged with listening in but only with using the information he received. (Not connected but he was subsequently convicted of arson!)
 
Take the lot off your boat and throw them in the water they are of no value. When approaching port use the mobile phone but most times you dont need to. I sailed the spanish portuguese english and many more coasts and never used the radio ever. At first I did not even know how to switch it on or anything about channels etc. When I was in the army signal corp I had to listen every night to the Ham net and make coms with a bunch of idiots. This gave me an abiding distaste for people who waste there time and money trying to establish signal strength and what the weather is, what amazes me is you need a licence to operate this junk.
 
I have to say I have a certain sympathy with the views of Das Boot. The only time I find it useful to have a radio (VHF or SSB) is for orginising social events. As was proved recently in a rescue, a call on a mobile phone to the relevent authortiy will elicit the same response. All this business of operators licences et al is a load of out of date old cobblers ----
 
how did you change your nick to Ex_Bambola michael? as the owner of mental pause flogged mental pause before we got there i'm in need of a change - mind you, i'm not going to use the new boats name either until i've done the renaming ceremony - don't even ask!
 
Just changed the name in my profile and waited for the 'Kim' team to ok it - couple of days.... Not quite sure how I will change the name to the new boats name when it comes - problably go througgh ex_bambola_xxxxxxxxx then drop the bambola after a while.. Not sure anyone cares really - they just want to try to keep the 'site' legit I think.
