Box ticking mentality means there's no room for humanity left.
We used to have a principle of "Equity" in our legal system
Anyway, can't he claim human rights as some unpleasant people have done.

This does indeed appear to be totally unjust. If this soldier had have been a European national with no connection whatsoever to the UK, and having made no contribution to this country, they would be allowed to stay and paid to do so! But because this chap is not European and the British Commonwealth appears to count for nothing, along with his 13 years service in the British Army - shameful.
That said, this is I think a Government and UK Borders Agency issue, not MOD.

common practice to accept the Commanding officers punishment, march in the office, receive the punishment, march out and get on with it. saves a lot of long winded hassle.not unusual for soldiers to scrap with each other, it gets dealt with, should not be a reason to deny this lad his chance to stay, he has certainly put more into the system than many have or will, who are living here free and easy.
