RYA Says we can go sailing - but only with our household.

I am right in thinking that the RYA in actuality don't have any authority or jurisdiction over anything? I'm not having a go at all just want to understand, happy to be corrected...:)
 
Here is the legal amendment to the regulations, my reading is no boat access or use if it is not in a public open space. Most marinas are not.

New sub clause (ba) "ba) to visit a public open space for the purposes of open-air recreation to promote their physical or mental health or emotional wellbeing— (i) alone, (ii) with one or more members of their household, or (iii) with one member of another household;”; "

Public open space defined as "5) For the purposes of paragraph (2)(ba), “public open space” includes

(a) land laid out as a public garden or used for the purpose of recreation by members of the public;
(b) land which is “open country” as defined in section 59(2) of the National Parks and Access to the Countryside Act 1949(a), as read with section 16 of the Countryside Act 1968(b);
(c) land which is “access land” for the purposes of Part 1 of the Countryside and Rights of Way Act 2000(c) (see section 1(1) of that Act(d)). "

STATEMENT RE RECREATIONAL BOATING ACTIVITIES

Despite reports that some recreational boating activities can re-start from tomorrow as part of the relaxation of lockdown measures, we have received no confirmation of this from Industry Trade Associations. There was no specific mention of recreational boating in the Government guidance issued yesterday and therefore the situation is unclear. We understand that clarification on watersports and boating activities is expected from the Department of Culture, Media and Sport in the next few days. We will be studying this carefully when it is received and updating our advice accordingly. In the meantime, our Port Notice Number 8 to mariners remains extant.

PORT NOTICE TO MARINERS NO. 08 OF 2020 Compliance with COVID-19 Measures NOTICE IS HEREBY GIVEN that restrictions have been introduced for recreational craft owners following the implementation of the Government control measures on 23rd March 2020. The use of recreational craft is not considered an essential activity and therefore operators of facilities such as pontoons, moorings and slipways should keep these closed to recreational craft so far as is possible until the current measures are rescinded. Skippers of recreational vessels arriving from abroad and putting into Falmouth Harbour out of necessity should make contact with their intended berth provider prior to entry into the harbour and comply with their instructions in respect of submitting health declarations and taking the necessary distancing measures after arrival. Operation of facilities in support of commercial craft are not affected by the current measures.

Absolutely that. Under normal circumstances we have 9 ITU beds in Cornwall. There is no need for those from “up country” to disregard the travel restrictions and potentially cause an increase in CV19 down here. When it’s all over we will welcome them back (well some of them)

They are the nominated governing body for sailing in the UK. They therefore have powers to organise racing as designated by the ISAF or the Olympic Committee.
They also have (or used to have) some training functions on behalf of the MCA.

Apart from that they are a members' organisation that represents the interests of their members, even when those interests are in conflict between different constituent parts of their membership (power vrs sail, etc).
But most of all they are keen to preserve their royal patronage, huge lottery funding for the Olympic sailors and most of all, their ridiculous name. So any 'lobbying' they might have done over this issue in the last month will have been conducted with due regard to these priorities and as a result, their effectiveness can be gauged by the clarity that now exists around us going sailing in all the speeches, guidelines, FAQs and legal provisions that have been issued in the past few days.

With contradictory government statements issued almost hourly yesterday, "try to keep up" is not the facetious put-down it usually is, but something to take at face value ;)

Given the utter shambles spaffed out by the Prince of Wiff-Waff, for now I'm uncharacteristically inclined to ignore the actual legislation-du-jour and follow the view of the relevant local organisations who can actually do anything about it. I haven't seen anything from ABP in Southampton yet, but Hamble put out a statement this afternoon saying, essentially, "river is open, please be careful". I imagine ABP will follow, given what others have posted in this thread it's presumably been coordinated amongst them.

The RYA have no specific power in this, but their opinion will help shape that of others who are trying to figure out what to do with the latest splutterings from No10.

you can stay overnight if you pay council tax for the boat as your primary residence,other wise it is a second home,and not allowed
Correct, and I do pay it. I'm happy to be living on board, it's normal, but missing my mates (and a certain lady) because they can't travel.

Yes Cowes HM will soon be issuing an NtM lifting restrictions ( or cancelling a previous one ) according the the grapevine.
 
Govt press release overnight allowing :

"all forms of water sports practiced on open waterways, including sailing, windsurfing, canoeing, rowing, kayaking, surfing, paddle-boarding and the use of privately-owned motorised craft (in line with the guidance issued by the relevant navigation authority) are allowed. You can continue to use towpaths for walking, running and cycling, being mindful of other users and people living in boats along the water "

Chichester harbour conservancy advice

While we await further government guidance, we are content for harbour users to take exercise on the water in kayaks, paddleboards and the like, and that the owners of vessels on moorings can access them to confirm their safety.

No mention of taking exercise on the water in boats... and they specifically exclude them by the second statement...

You're absolutely right. Individual operators/businesses have to make their own decisions. The RYA is only one source of information and guidance.
 
Fairview Sailing on the Hamble have just mailshotted me offering day charters effective immediately so that I and my family can go out.

The only slight flaw is I live alone with no family to sail with. As I don't own a boat either my chances of getting out at all look a bit thin.

Would anyone care to adopt me, I can then legally crew for you. I'm a non-smoker, house trained and very low maintenance, I'm sure you won't regret it :)
