They do for such things as speeding & parking ticket etc...................so why not ?

Simple, those are absolute offences, and you have the alternative to go to court, or in some cases to an independent review if you think the charge is wrong.

And then see if the magistrate thanks the forum for its expert, professional, and unbiased assistance in determining the verdict two years ago .....

a lot of thinking and re-writing of local racing rules, harbourmaster's regs, and similar control environments needs to be undertaken, to make sure the lessons from this incident reduce the risk of further accidents.

Why shouldn't 'inexperienced, clueless and foolhardy people' be on the water? Surely they have as much right to be there as anyone else?

Not a biased Judge then. Do you think he was a member of the RYS?

These have been streamlined because the number of them would overwhelm the courts if all had to be formally prosecuted - but you do have the right to refuse the streamlined process and be properly tried in court if you wish.

Since Mr Wilson pleaded not guilty in this case, one assumes he'd have taken that option if marine offences were streamlined the same way.

Or just one simple line... don't play near the big red ship.

Having read most of the postings on here and what I could in the press I have come to the conclusion that the whole crew, well perhaps not the member of the crew who bailed out before the impact, but I am sure he lives in Poole and swims a lot, had "caught in the headlights" or "red mist" syndrome.

There is a fair amount of research on the behaviour of aircrew in crashes that indicates that there is just too much information to be processed by the brain to take a rational decision at the right time. Perhaps this is what happened in this case - not being a racer it is not a situation that I will ever be in as I keep away from the big stuff.

He was ordered to pay costs in excess of £100,000.00

Wow. That’s got to be sobering for every boater … the consequences of a dumb/reckless decision or mistake can cost, in addition to a refused insurance claim and injuries/lives, a six figure sum. Bankruptcy is amongst the risks we take every time we go out!

And in this case, it's probably cost him his naval career & a gold plated pension too.

I would fully expect the costs to be dramatically reduced on appeal. There is a criteria that costs must not be disproportionate to the offence.
I wonder what his own legal bill is?
