Apparently a ‘ship’ is only entitled to fly the red ensign if British registered. I wonder how many yachts are flying it illegally.

All British yachts under 24m, whether or not registered, are entitled to fly the red ensign. From the Merchant Shipping Act, 1995:

1.—(1) A ship is a British ship if—
(a) the ship is registered in the United Kingdom under Part II; or
(b) the ship is, as a Government ship, registered in the United Kingdom in pursuance of an Order in Council under section 308; or
(c) the ship is registered under the law of a relevant British possession; or
(d) the ship is a small ship other than a fishing vessel and—
(i) is not registered under Part II, but
(ii) is wholly owned by qualified owners, and
(iii) is not registered under the law of a country outside the United Kingdom.
(2) For the purposes of subsection (1)(d) above—
"qualified owners" means persons of such description qualified to own British ships as is prescribed by regulations made by the Secretary of State for the purposes of that paragraph; and
"small ship" means a ship less than 24 metres in length ("length" having the same meaning as in the tonnage regulations).
(3) A ship is a "United Kingdom ship" for the purposes of this Act (except section 85 and 144(3)) if the ship is registered in the United Kingdom under Part II (and in Part V "United Kingdom fishing vessel" has a corresponding meaning).

2.—(1) The flag which every British ship is entitled to fly is the red ensign (without any defacement or modification) and, subject to subsections (2) and (3) below, no other colours.

(2) Subsection (1) above does not apply to Government ships.

(3) The following are also proper national colours, that is to say—
(a) any colours allowed to be worn in pursuance of a warrant from Her Majesty or from the Secretary of State;
(b) in the case of British ships registered in a relevant British possession, any colours consisting of the red ensign defaced or modified whose adoption for ships registered in that possession is authorised or confirmed by Her Majesty by Order in Council.
(4) Any Order under subsection (3)(b) above shall be laid before Parliament after being made.

Or are you suggesting that there are many foreign yachts illegally flying the red ensign? Don't forget that foreign owned yachts can be registered in Britain (sometimes in order to reduce tax). Also that many of the former colonies, including yachting flags of convenience such as Gibraltar and Cayman Islands, use a defaced red ensign for their jack.

According to the aforementioned Merchant Shipping Act 1995, ensigns are flown. Mind you, we did use to wear Union Jack flag knickers back in the good old I was Kaiser Bill's Batman nineteen sixties. I think maybe you've got it the wrong way round. Wear flags. Fly ensigns. Yes. What about Jacks? Play them, obviously.

Most liveaboards and serious sailors only fly the raggy thing to show they speak english, nothing more.. we - the wintering boats at LC are making our own European flags with the country flag in a small corner.. dont give a wotsits if its not 'correct' and neither does anyone else..

Fly, wear, hoist, waggle.. its all the same.. haul it up on a bit of string..

DONT fly a blue flag though.. you will ust be given a wide berth.....

If it is to show you speak english and you dont care, you could save a fortune and just fly a Union Jack bought off the beach sellers. What would a euro flag in the corner of a red ensign signify? Seems a bit pointless?

PS. Please have a go at anyone wearing a blue in your area - the warrant is for use in home waters only.
 
I spoke to the representative at the registrar of seamen and shipping about the benefits of part 1 or part 3 registration. During the conversation it was pointed out that only registered yachts should fly the ensign....maybe she was wrong.

Apart from anchors and lifejackets, there is more total bollix spouted forth about soddin ensigns, than just about anything else within these forums......

Blue ensigns have me doing one of two things, either falling about laughing at the silly twerps who seem to think that somehow it gives them more status / credibilty........

Or, throwing up, at the insufferable snobs and their self important pomposity, which you can see demonstrated in just about any marina in the world.

Further to the aforesaid, I reckon that the good old red duster is the senior flag and should be worn with pride, when appropriate......(like when you want folks to know that you speak english).....It is the oldest ensign, therefore the most senior, regardless of what the blazer an' yottin cep brigade might want to think /forums/images/graemlins/tongue.gif

I wear the blue because I can. I served in the Royal as have many generations of my forebears and am proud of it. I was a lowly rating and am by no means stuck up, pompus nor a snob. Each to his own. I'm also a socialist. The blue ensign gives me no status or credibility....that is your perception.

I agree that many how "fly the blue" are of this ilk but please spare me your scorn. There are arsehols that fly the red as well

If my history is correct they wore the red, blue and white!

I'm thinking that the people who put it upon themselves to pile scorn on others are the ones who think they are better and yes I've met many arseholes who fly the red. Of course you wouldn't be one of them (hem)
 
Read the link that I posted, and you will see that the red duster was used for a long time before Nelsons squadrons.

Ergo, the red is the senior ensign. However, it all matters little really, you can wear your missus's knickers if you wish! /forums/images/graemlins/grin.gif
