That is not true in Spain where you need a Spanish licence to skipper a Spanish flagged boat. That is a big barrier to a non Spaniard who wishes to buy a boat in Spain, hence the popularity of registering under a different flag.

My Spanish friends who lived in the UK moved back to Spainand have their boat under British Flag and haveUK RYA qualifications.Latest news is they are being find for not registering their boat on arrival.Under the law they can use the boat as is.

That's very interesting, I'd be interested on what legal ground are they penalizing other EU flags... Mandatory equipment/survey maybe?

"Moved back" suggests they are resident under Spanish rules (ie more than 183 days) and then you are required to import the boat and pay a matriculation tax. However, there is no need to register under the Spanish flag.

Indeed, all taxes are due, no surprise there. I suppose the RYA qualifications also have to be converted to a Spanish license. Mandating a flag state would have been weird, to my knowledge many Spaniards sail under Dutch/Belgian/etc flags.

If one is resident, the boat should be imported and a tax paid. However, the requirement for reregistering under the Spanish flag and taking Spanish qualifications was ended years ago.
