Private boat sales at Kip Marina

If you happened to sell your car when it was in a Council car park, would you expect the Council to demand a share of the proceeds? Why should a marina be any different? But if in doubt, ask the forum, and you'll get a satisfying variety of answers, or you could spoil it all, and just check with the marina. :rolleyes:

Indeed but when you ask the marina and they point you to the clause saying 1 or 2% is due on all sales within the marina what do you do then.

Dunno about council car parks but selling a vehicle in the carpark is against the NCP T&C
 
Worth checking if any case law on this sort of thing falls under Scots or English law? Also hope nobody concerned with Kip Marina or Holt Leisure reads this forum?

I cannot conceive of an answer not already provided for by the standard marina fee and, if no goods or services of value are provided by one party in a contract, then there is no contract, there is a promise which no longer has any standing in English law, ( I know Kip isn't covered by English law, but I'm in England.)

Indeed but that doesn't stop them trying it on to the point that you have to challenge them in law.
 
I looked at selling a boat through them but decided not to after reading the T's & C's.

I understood the agreement to mean that as soon as I'd signed it I was liable to pay them a cut of the selling price - even if I sold the boat while the agreement was in the mail to them and they had not lifted so much as a finger to progress the sale..

In the event I sold the boat privately that week so would have been liable for a good chunk of hard earned for absolutely nothing if I'd signed.

Presumably you mean that you were considering employing Kip to sell your boat, and obviously if you had, you would had had to accept their terms. As I understand it, the OP just happens to have his boat berthed there, and Kip would be taking no active part in the sale. Totally different situation.

a three day blow hiding below in a minstrel is jolly tough

in a centaur it is okay (ish)
 
Yes but engine changes are no big deal; try saying that about the Centaur !

Everthing from sails to berthing fees a whole level cheaper...

Just enjoy her being ' cosy ' not cramped.

Well you wouldn't need your tea lights for a start; just bask in the warm glow on your phone / laptop whatever, when you check your bank balance ! :)

As of course you know, a cockpit tent is jolly handy in these situations - I just use a strong rectangle with lots of eyelets draped over the boom, even that is very effective in British ' holiday weather '; something a bit more elaborate would be a boon for you, but increasingly expensive if you haven't got one already.

Current 2017 berthing contract - Rules of the Marina - Clause 30. Says that Kip are due 1% + VAT from the sale of a any boat where there is a current berthing contract whether sold within the marina or outwith the marina. Not the exact wording, but they are due 1% + VAT.

That said I have sold two boats from the marina over the past few years and they have not charged me despite knowing what I am doing. Maybe they just take a view on each case. I don't really want to ask them in case it raises an issue!!
I assumed that they didn't charge me as I have been at Kip for many years and likely to stay there as long as I have a boat. They know me very well, I don't give them any hassle and pay all my bills on time. My guess is that they won't charge a long term berth holder, but may well charge if someone unknown takes a berth then uses the convenience of the marina to sell their boat. That's just a guess as I really don't know.
