Can you just imagine the field day for the lawyers. Was this, or was it not, idiocy? What degree of idiocy? What level of sanction is indicated?

Yep. Hard cases make bad law and plenty of money for the lawyers.

How should the necessary law be drafted, I wonder?

I don't think this really supports the argument.

These people must have been scared out of their wits. They clearly came close to drowning themselves and their children. Most unlikely that they will repeat the exercise.

I can't think of any penalty that will have a deterrent value to match that.

In almost every case the sea frightens enough sense into people without actually killing them. Very occasionally someone does lose their life. We all know that. We all know it could be us. We all choose to accept that risk, we don't have to, it's our decision. I do not see that government has a role in that process.
