Marina rules

Quick question;

Can a Marina move you round within the marina at their whim? We have a berth that they want to move us out of as they have a bigger boat that they want to put on our current one. They are offering us a different berth, longer but narrower at the same price. Obviously longer doesn't help us at all!!

I am not able to look at the contract to see if they can do this at the moment.

Their attitude is that they can do this if they want and if we don't like it, sod off ...
 
Have been through this very situation, chances are you are paying for boat length rather than berth size, we had an 8m boat in a 10m berth and after restructuring they gave us a choice, pay for 9m or move to a smaller berth and pay for 8m, I would find out how much difference there is in what you already pay and what the marina will gain by re-allocating your berth to a larger boat, if you like your berth or plan to upgrade boat in future paying the extra might be worth considering.

We did just that payed the extra and bought a 10m boat a couple of years later without needing to relocate.

having had a few arguements on behalf of berthholders they are right. They can do (within reason) what they like, and there is nothing you can do about it.

The only way you can argue is for H&S reasons you may be able to complain if that were the case but as far as most rules within boats go its simple, there are no rules, do what they like, charge what they like, and treat you how they like.
 
Thanks for your responses. I figured they had the 'upper ground'! We have been on a pretty well positioned berth for a few years now and it is easy to get in to and has a nice all-round view for when you are having the G&T's ;)

We have been umming and aahing on and off for a while about moving marina's so maybe this is the thing that will make our decision.
 
As I understand it the marina is obliged to provide you with a berth, rather than your own permanant berth. Whilst most of us stay in the same berth and think of it as our own, the marina is well within their rights to place you in any suitable berth.

you can only sod off at the end of the berthing contract.
Premier marinas
If for example they want to move you after 3 months of your contract they can do. If you dont like the new berth and leave they can send you the bill for the remaining 9 months of the contract.

MDL

would charge you monthly visitor rate for the 3 months and then let you go with about 45% refund.(depends on time of year)
 
Berths

Had a similar problem a few years ago came back from 2 weeks away from the berth we considered ours ( rightly or wrongly).
During discussion's with the marina they stated they can re allocate, to a berth equal or greater than your currently rented berth, and that you should call in EVERY TIME you return to the marina to check your berth is still available.
Imagine the fun we could all have on a busy weekend with that statement.
