Exactly. The complaint is nothing to do with how much tax is paid - even if we paid full road duty on all the fuel they would not be happy. Their rule is simply that diesel which is coloured red or green is not allowed into pleasure boat tanks.

Except that it doesn't imply the incorrect tax, because (on paper at least) we're paying full tax on all the fuel we use for propulsion. If I want, I can go down to Itchen Marine Towage and fill up with 100% tax-paid red diesel. I did once. But the EU still thinks it's wrong, just because of the colour.

How come the UK is the only EU country that complies with all the Brussels ridiculous/**** rules. Take a leaf out of the French book, and simply ignore the summons. What can they do? Chuck us out? That is just not the case. Most other states in the EU have fallen foul of EU rules and been forced to change, either by the commission or by the court.

This is a pretty minor thing and UK is the only state that has not complied - even though the directive is many years old and UK was given several years dispensation to comply.

There are many people in the UK who think we should comply and it is vested interests (not least the oil companies and fuel station operators), not just users who are resisting. So far the government has gone along with those lobbyists, trying to find compromises but has not backed down.

1 As we have never been given any opportunity to vote for the 'EU' I certainly do not recgnise the authority of the European Court. As far as I am concerned they can go hang.

Its the EU by the way and dont blame them. We signed up to an agreement with two provisions - leisure users to pay the full duty, and duty free diesel to be marked with dye. We asked for and were given years to implement to allow for white diesel to be made available at every port etc and hmg did sweet fa. In short be are breaking an agreement that we willingly signed up to. Done blame the EU if hmg dont keep their word.

This one is nothing to do with HMG - they don't sell you the fuel. The only criticism that can be made of the government is that they didn't enforce the rules - there has never been anything stopping marinas from stocking unmarked diesel.

Everything to do with government. They gave in to the lobbyist (for sound reasons from their point of view) and have stuck with it. The potential difficulties individuals face is largely due to government policy.

It's not silly to say you don't think we should be subject to the European Court, but it is silly to deny that it has happened, or to expect "not recognising" it to make any difference.

Not only those who take their boats abroad. Those that want to use white fuel have difficulty because there are so few waterside sources.
