Someone contacted me about keeping/moving his yacht to my 'home port' in Burriana Spain.
I am not sure of the correct response so turn to my 'learned friends' here.
Might be worth asking about our own 1980 yacht which is UK registered but has been in the Euro Med for 5 years.
I have recommended he joins the forum but meanwhile will pass on your responses!

Dear Sir. Please forgive me for contacting you. MY reason is that I have for a few months now been trying to find out about keeping my yacht in Spain. I have been finding it very difficult to get reliable advice about this. By coincidence awhile ago I was contacted by Marina Burrianova offering a leasehold berth for a reasonable price. I would indeed like to keep my boat in Spain. However I have my doubts about keeping her there, as I understand that any stay alongside in Spain for more that 6 months for a foreign registered yacht can lead to seizure of the vessel and fines to be paid. I believe the only way to avoid this is to depart for another port outside the EU for a further 6 months before being legally able to return to Spain. I understand that the obvious solution is to register the vessel in Spain, but then I understand that this involves getting qualified by the authorities to be able to skipper the yacht. My RYA cert would not be acceptable.
So apologies for this overlong email but I would very much appreciate any advice you may be able to offer on this subject.

I don't think the OP is a scammer at all, the eBay connection might be causing the problem.

Just to explain! I have a yacht share for sale on ebay, its based at Burriana. Tony saw it and had been thinking about a move to Burriana so asked me what I knew about the possible changes and regulations.
I can see that it could sound 'scamish' but, then, he is only asking for info so hardly posing any risk.
I have looked for answers elsewhere and have advised that it is perhaps best to just see what our 'oven ready deal' turns out to be then search again. At this time I dont see any onerous implications with our own boat staying in Burriana but possible issues if we want to move around.

If it was me, I'd wait for the dust to settle, most of this is guess work at best.
 
From advice I've obtained there is no suggestion the yacht is at any risk of staying indefinitely in eu waters as long as you can show the boat was there December 31st 2020 and have usual proof of vat paid etc. The restrictions are on the person, not the boat

Thanks, yes that was my understanding but Tony is thinking of moving there so a different situation for him. VAT could be an issue but I think my ancient yacht doesn't pose a problem!
