All the chat on DSC was good now Mike Martin seems to has gone silent.

My last post set out a senario (which he never answered) . I Quote " I passed my driving test, later that day, I drove (legally) unacompanied on the open road it was great", although it was 40yrs. ago I still remember it. To Mike, I was putting forward the question, can I use DFC or not ( I passed the exam) if I have to wait 2 months for my licence, will I be commiting an "offence" if I use DSC. befor receiving my licence. Some "Sages" say yes, the argument being when you pass your driving test, you have been a provisional for some time, therefore you are on the "computer". BUT in this instance (the DSC exam) you are not on record untill all the paperwork has been processed, so I ask again to M. M. will I commit an offence if I use a DSC -- VHF--before I receive my piece of paper ( sorry encapsulated plastic ) with my picture on it.?

With the penalties for "misuse" being heavy to say the least, we (not the royal we) me + the rest of the raggies who have "been there , done the exam, got the tee short, paid the fee etc" need to know"?

Mike, give us the truth behind the problem.

The licence for the device comes from his department but isn't the operator's cert issued by the RYA? In which case it'll be outside of his remit.

Firstly there was a significant post on exactly this subject about 3-4 weeks ago - suggest you run a search.
Secondly your reference to photo licence is confusing, and as stated the issue of that cert is not Mike's domain.
The gist of the previous post was that if you had the valid ships licence with an MMSI number, had an existing VHF operators licence and had passed the DSC test and submitted the documentation with payment it was unlikely that the RCA would prosecute although you are technically breaking the law (clearly Mike can't confirm that in his position). Further it was sugested that were you to cross into another countries juristidction you might well be fined!
This is an open forum and Mile does what he can, often in his own time, in the interests of widening everyones knowledge and helping out. I don't personally think the tone of your post recognises that - if you wish a formal response then submit your question formally to the RCA by the channels they offer - and if you get a silly response then come back and share it with us!

Hi Gents,

No I haven't jumped ship, I've had no free lunch times !!

The Certificate of Competence and Authority to Operate although no longer issued by DTI (having been transferred to DOT in 1997) are still under the auspices of the Wireless Telegraphy Act and enforcement is still carried out by the RA. It is a condition of your Ship radio Licence that you hold the relevant certificate for the equipment which you are found to be operating.

However, the actual enforcement actions that would be taken are outside of my remit (being a different branch of RA) and I will need to ensure that I have exactly the correct opinion of my opposite number in Enforcement Policy before I can answer you properly.

Sorry Mike,

Just wondered where my money has gone.

Keep the faith it will work. Yesterday Sunday, " Off shore near R*****"." Like many in Fraserburgh, my quotes are of coures not accurate as I do not have a tracker as I dont have a licence. Son calls father (on mobile phone) "Dad I am taking on water". In the best Scotish tradition father replies"Nae bother ma loon I/l call the Coasty". Dad duely calls the CGs and informs them of sons probs. but does not have sons mobile number so CGs ( staying cool with a little edge to the voice) has to up grade the"Pan Pan" to a Mayday (of sorts) sends off our faithfull the RNLI to sort out another "d***head". They towed him in and I hate to think of the words that were said. This was Sunday Morn. In Scotland you either have a bad hangover or are off to the "Kirk" at this time of day. Yes I will vote for full DSC compliance Mike
