What should be covered under a dealers 3 month warranty ?
I've been told its just the mechanics.
As with a car purchase, its anything that breaks or stops working under normal conditions of use. So why not for a boat?

Nothing given as yet.
Just going on what the dealer has told me so far. No money has changed hands but interested to know.
I was wandering if the sales of goods act covers all types of purchases regardless of what it is. Whether a warranty is given or not.
Or is it caveat emptor?
 
Sale of goods act (consumer rights act these days) applies in Uk, provided the dealer is the seller and not merely the broker, and provided buyer is really C in the B2C sense. ie you have not set up a charter company etc to buy the boat.
 
If it is boats.co.uk providing the warranty they are honourable in fixing stuff.

The warranties by dealers will usually cover things that don’t work or break as opposed to servicing and general maintenance items which unlike a car are pretty extensive. Also you are likely to get second hand parts in my experience.

The law I believe says it should be of merchantable quality and be in a condition proportional to it’s age and the price paid - ie they will make sure it works but tou are not going to get a new boat or lightbulbs replaced

Yes but it depends on the fault being there at sale. The dealer must proove it was not. Given most boats are surveyed I would imagine most dealers would say ( if you got all legal ) that the trained surveyor you instructed could not find the fault so it was not there at the time of sale.
However a warranty is for faults that develop or are discovered during the warranty period.
 
3 months is not very long so you would need to use the boat frequently and be sure to use everything to make best use of any warranty benefit.
 
Is this a warranty provided and backed by the dealer himself or a warranty that is provided through the dealer by a third party where you have the option to pay to extend the three months for as long as you like.
I have no experience of the former so no comment on that, however I did have experience of the latter when I bought my current boat. The fuel pump failed within the three month period. The ensuing wrangle (which I detailed in a post at the time) was like dealing with a car insurance claim 20 years ago. After much wrangling they met less than half the cost of the repair and it would have been cheaper and quicker for me to sort it out myself. Needless to say I did not extend the cover!

There are in effect two answers on here

1 what does the warranty cover
2 what does the law say.

re 2 it covered pre existing faults in essence , the warrenty covers what they say it will cover which is usually the big expensive bits in my experience

I can only speak for boats.

On my T40 I had a bow thruster, fresh water pump / accumulator and a set of batteries. There might have been some other bits.

I PX it with them and 5 hours later it did a leg that they replaced.

Re the bow thruster they were going to send an engineer to La Rochelle, stay overnight and then return next day. I could not let the do that and they stuck it in the post. Took 30 mins to change.

That is my understanding. I remember when the legislation came in and my reading was that where the boat is sold by a dealer i.e. they actually own it as opposed to acting as a Broker, then faults that occur during the six months following the sale are covered.

My only experience with this has been NYA and they have been very honourable.

Ask them how much less the boat is without the warranty?


It’s the consumer rights act..... It is UK law how can that be set aside

Also I think the Consumer rights act is 6 months

Apart from all this Russ it is about time you bought that boat
 
That’s what I would do, treat it as a brokerage boat and buy at brokerage price.

Don’t think it works like that. Selling a stock boat brings a legal obligation to rectify defects - don’t think it could be avoided. I haven’t found stock boats to be over-priced - they have to compete with brokerage boats so there is a limit to the premium that people will be prepared to pay for the peace of mind that pre-sale preparation and some form of warranty brings.

In which case I would look at what I could buy one for on brokerage and value it in a way I was prepared to take the same risk as buying a boat without warranty. Then if anything goes wrong I would see any dealer contributions towards repairs as a bonus.
