no foresail is set, it is a clear indicator that they are using the machine.

A quite normal situation on Windermere. Each boat has it's own wind so both are on port tack. However it will shift in a moment so one or other could easily go onto to starboard tack.
The usual think to do in these situations is to gaze away from the the other boat and assume he will do something sensible,
the fox is clearly capable of making good judgement calls so lets leave it in his hands........
..........but that's no fun so I will chuck in 2p by highlighting the bugree/flag/streamer on the top of the mast on the approaching boat with suggests it's on starboard despite the foresail!

With the mast that far forward you wouldn't want a foresail. Besides there's no forestay to attach it to. Nor shrouds neither - I wonder if it's really a junk rig that's been jury-rigged as a bermudan? A loose-luffed bermudan...
