Can I Offer a Day Out on My Boat As a Raffle Prize?

I hesitate to get involved in threads like this because I always say the same thing which is that if anyone wants to take people out on their boat other than friends and family then they need to get the boat coded appropriately and have the right qualifications themselves to operate such a coded vessel.

I always get told told that I am wrong and an unpleasant killjoy because:

1 "I know someone who does this all the time and they have never had a problem"

2 "I can just say that they were a friend: I met them five minutes before they stepped on board"

3 "I spoke to my insurers and they say it's fine."

Well, my view on these points is wrong, wrong and wrong again. The first one is obvious. The second will be denied by the injured party and the third may be the opinion of an individual which when the issue arises will probably not bind the insurer under a policy which specifically requires the insured to comply with legal regulations - such as coding.

So, in short, it'll probably be ok, right up to the point when it isn't.

If you read the definitions you will see that you are wrong. No problem with taking people out. Friends of friends or people you have just 'befriended'. Who's going to argue the difference with any reasonable chance of success?

I'm afraid that in my humble opinion you are not only being a killjoy but actually doing a disservice to the yachting community by promulgating such opinions.

What is decidedly dodgy is where people take people out for money 'on the quiet'. That is most definitely wrong!

I was involved (on the periphery) when the coding regulations were being written. I don't recall ANY intention or suggestion that taking friends and acquaintances out for a sail should require you to get you boat coded.
