Burton Waters & a costly learning curve

I'll flag up first I am a broker (sail) and have no connection with BW.

But from what I can see the OP signed a contract to purchase a boat circa £100,000. The deposit was 10% but as it was late the OP paid £1,000 and promised to send the other £9,000 the following day.

Then did not send the balance and defaulted entirely outside the terms of the contract. i.e. subject to survey or finance approval.

And BW gave him back most of the deposit which in itself the OP had not paid in full. So the op "lost" 0.25% of the deal he had signed a contract for.

BW lost the sale of a £100k boat that was at signed contracts stage and now have to start again. Having spent however long showing the boat or going through it with the OP.

Can you imagine what would happen if I took a deposit and signed a contract to sell a £100k boat to a buyer and I then phoned him up in the morning and said sorry I'm not letting you have it now and the contract doesn't count.

Contracts and deposits exist for good reason and are not trivial. They should not be entered into if you want them to have no consequence if you change your mind or the rules. I think BW did well refunding you. They certainly don't seem to deserve a public dressing down based on the story we have heard so far.

Put it down to experience but realize it is you that has not delivered not BW.
Considering that you have defaulted on £100k they have been pretty good about it, unless there is more to this that we are not aware of or the contract is markedly different to an RYA or ABYA contract.

Thats the point , I thought the boat was 100% right for me,it was only after receiving the advice I changed my mind.
I say again, it wasnt the full deposit........nah cant be bothered anymore.


Interestingly I have held off commenting on this thread, but if a boat is 100% right for you then the advice you receive will be based upon someone elses idea of what is right. Although I too would prefer the Targa, I have many friends that have Sealine running through their blood.

If you change your mind you change your mind and that may have been subject to the terms of whatever pre-agreement contract you signed. Luckily it was a stock boat as if you had made an offer on a brokerage boat and that offer had been accepted you would have been obliged to complete - albeit 'subject to survey'

However, I wish you well with your new purchase and hope to see you on the water. Ancasta have a superb reputation, but so do Burton Waters and I'm sorry that for whatever reason you ended up having a bit of a ding dong with them. I personally have never done business with them but many of my friends have and I often walk into the Ipswich office and have never had anything other than politeness and found that the guys have time to chat.

Having read this right through I can see both sides of the argument, however the OP's "expert advice" has to be questioned, an S34 with KAD32's is not badly underpowered there have been many forumites on here with S34's and this setup who seemed happy also the expert advised againest using BW but there has been nothing but praise for them on these forums. Clearly BW could have refunded the whole amount but didn't feel inclined to do so, there is such a thing as a bad customer even if he is always supposed to be right:D
 
what i find mildly amusing is the fact that someone comes onto a forum full of principles and upper management to complain about how a company is run and still admits that he caused the upset in the first place.

i think the op may be in for an awful time if his expectations are thus.

When I was looking for an S34, I considered those with KAD32s to be very underpowered and also rejected ones with AD41s. In the end, I found one with twin 260hp D4s.
