Bought a new boat but delivered without a CE Plate

We rejected a Sealine S34 once because the plate was wrong, never mind missing (luckily we were only at the paid deposit for a specific boat). Trading Standards might come under consumer direct to, think you can go for 'fix the plate or full refund route' please. What ever you do, back everything up in writing and give them a clear date (seven days usually) to rectify the problem or you 'reject' the goods. Always better to start with the aim of getting it fixed.

they have been aware of the problem for along time, ( 3 Months since I purchased) It would be such a easy fix if they just sent it to me... If no reply on monday, I will go down the trading standards / creditcard route.
I dont think I have a chance of a full refund to be honest..,

Very surprising error from a very large builder! If I remember correctly it was the fact that if they could get a "small" thing like the CE plate wrong, what else might be lurking under the surface?
Still, you got a far nicer boat as a result! ...even if you have been foolish enough to go to the darkside since! Love to the family!

Pops up if you try to order an accessory. You need to contact your credit card company NOW. Tell them you have tried to resolve this issue over the past 3 months, tell them you are rejecting the goods NOW. Tell them you want a refund in FULL.

Money back, go buy a decent boat from a decent manufacturer. Do NOT accept a part refund to cover the cost of CE marking. If they have (or are about to) go bust, you'll have a brand new boat with no warranty. If they aren't about to go bust, they are a hopeless company to deal with, partly for not fitting the plate AND supplying the docs, but more importantly for not putting it right. Get your money back from the credit card company and go elsewhere.

My money is on them going bust.

I'd guess the insurance will be invalid too.

Why? I've just checked my GJW policy - OK, it's for a sailing boat but it's their standard conditions - and there is no suggestion there that my boat would not be covered if any documentation was missing. I do have to undertake to keep the boat in a seaworthy condition, but I hardly think a missing sticker counts as "unseaworthy".

Thanks paul for your input, I think you may be right. I do feel pig sick at the moment... So I tell the credit Co I want to reject the goods? and tell them I want a full refund? because I know the company would say NO if I asked for a refund.

Do you think the chances are god on having a full refund? because what I actually have is a useless boat worth really nothing at the mo because I can not sell it.

With the greatest of respect - you can't even get hold of the company concerned to talk to them, let alone discuss a refund....

It's credit-card company all the way now it seems.....(and be firm with them!)

The guy is a liar and is almost certainly either bankrupt, or in the process of going bankrupt, i'd bet my nuts on it. The Ebay listing is for a half finished boat, with a bollox story of why it's for sale. I'll bet he's trying to shift it to either, raises some urgent cash, or to whisk it away before the official receiver or the bank gets their hands on it.

He's also not the brightest of liars, he give a number in the Ebay list, to "call them direct" and he also lists "his own" mobile number, the number he claims is his mobile number is the one listed on the used boats section of the JRS marine website.
 
I hadn't realised that the Paypal link i posted earlier would expire. If you visit the "company" website for JRS Marine and click the accessories link, then try to add something to your basket, it immediately takes you to the PayPal website. Once there, you get a message from PayPal stating

"This recipient is currently unable to receive money."

"At this time, we are unable to process your request. Please return to JRS Engineering LTD and try another option."

Interesting. That's the same name and address for the company "JRS Engineering Ltd", the company that is the holder of the PayPal account that you're directed to from the JRS Marine website. The Ltd company is listed at companies house as being dormant.

You really MUST contact the credit card company. Tell them of the issue with the CE documentation and plate and tell them in no uncertain terms that you are rejecting the goods and want a refund in FULL. It is illegal to sell the boat without the documentation and plate, so you are entitled to have them supplied, or a refund. You cannot get a reply from the company, therefore you want a refund. They might try and fob you off, have none of it.
 
If everything goes tits up - for whatever reason; you still have the boat. It is none the worse for the lack of a silly plate. It is perfectly useable & enjoyable as it stands. You MAY have a problem if you go onto mainland Europe (if anyone spots it) and you MAY have a problem selling it (again if the buyer spots it). If you do not intend doing either of the above you have no problem.

Why not contact someone with a similar boat & make up a similar "CE" plate to theirs? What's the chances of anyone ever looking that closely? Unless they have read this thread that is! :eek:

He doesn't have to have a boat with no CE docs, no CE plate and no warranty though. He can get his money back via the credit card company and buy a boat with proper documentation and a proper manufacturers warranty.

If the company has indeed gone tits up (or going that way), what's the chances that they threw the last few boats together. Maybe they skimped on the materials a bit to save a few quid.
