Bought a new boat but delivered without a CE Plate

It is a new boat, right? i.e. not new to you, brand spanking, gleaming, shiny mint thing?

Worth checking things like the following it having an auto extinguisher in the engine bay

A bit difficult on an outboard. :)

No phone/emails are answered & 4hrs away... Ill just keep phoning I guess...

Write a letter, recorded/guaranteed delivery, and point out that you require immediate confirmation that the boat complies with CE certification and once that is done, an official CE mark professionally applied.
 
How did you pay?

If you paid for the boat by credit card than you should be able to claim from the bank that issued your card, if the worst comes to the worst. They in turn will pass the claim on to the merchant's bank who will work very hard to get their money back from the merchant. Even if you only paid a deposit on your card you can claim for full amount.
 
I would contact both BMF (British Marine Federation), the trade body for boat buiders/suppliers, and the Government dept BIS (Business, Innovation and Science), who police CE marking. I am sure they will be very interested and helpful.
 
Are you sure if you only pay a deposit on a credit card that you can claim back the full balance if things go wrong?

I would have thought the balance of liability to the credit card would max out at the amount paid on that card!

Very very interesting if otherwise, as you could pay a deposit for things like cars, etc on a credit card and have some (minimal) insurance against problems....


Also, doesn't the credit card only cover you against you not receiving the item, not if there is a small (albeit in this case vital) problem with that item.

I know the credit card insurance is better than nothing but not as good as if for example you were buying it on finance.

Are you buying it on finance? If you are, then also contact the finance co. Legally, the finance co are liable too, as they have paid for the boat (so they have a contract with the company they bought it from), and you are now buying the boat from them in installments, so you have a contract with them.

If the goods are not of "Merchantable Quality" (which they can't be if they haven't got a CE mark as they can't be sold) then the finance co have "supplied" you with goods that are unfit, and you could return the goods to them and receive a refund.

Did you buy it on finance (note:- a personal loan isn't the same thing and you don't get the same protection as they lent you the money and then you paid the seller).
 
Bought on credit card, no finance options or anything like that.
I phoned credit card company today & told me 6 months charge back & after that you do it by writing.
So there may still be hope... As I have the boat without the plate, how much do I claim, I guess its unuseable as it is.

You must get this sorted out immediately.
Either reject the boat, get the plate sorted in the next day or two or approach trading standards etc etc.

It is almost definitely a genuine mistake from the builder, but they HAVE TO SORT IT IMMEDIATELY.
 
Thanks for that.. will give a call on monday, if no answer will approach trading standards, I have offered to accept them posting it to me, but no reply as of yet.
 
Does sound a little iffy with the phone just ringing out and no replies to emails etc...

Maybe your boat has been one their last? I hope not and I hope that it is simply that it's a very small company, the owner made a mistake and forgot to fit your plate, and forgot to supply your declaration of conformity and has now gone on holiday for the winter.

Your boat won't be too much as I have a feeling that in theory, the model at least is CE marked.
It's not the first one from the mould of a new model is it?

I am positive it is simply one that slipped through the net.
Probably wheeled out of the fabrication workshop late on Friday and it was forgotten.
This isn't an excuse as it is inexcusable, but it's what I think happened/

If you really had to go as far as getting it re CE proofed then I think it would simply be a look around a tick in all the right boxes and a declaration of conformity issued.
 
Also, without being disrespectful, your boat isn't the most complex of vessels! It has a cabin, and a huge open deck, so not a great deal to actually CE mark anyhow.

I agree too, that if you can look at another model and show it's CE marked, then it should be a cheap job.

BUT - as to how much to claim back from CC company, why not all of it?

It's an opener after all not what you'll settle for, and if they just paid it all back, you'd have a free boat!!!!!! (note:- this won't happen - just a pipe dream!)


As to ringing the company, is it a sales line - or their only line that's ringing out.

Just a thought - use someone elses mobile - it's just conceivable they aren't answering it because they have call minder, or Caller display and it's showing your number, and they don't want to talk to you?

FWIW - Trading Standards will take a lifetime to do anything and you may not have that long - by all means notify them but DON'T wait for THEM to sort it, you'll be waiting a long time!

Thanks for that... I am looking at 'CE Proof' If things take a turn for the worse.
I don't think its a sale line. I have tried different numbers. Could be a genuine 'they are not at the office'

Which Trading standards would be interested? I know there is a trading standards for each county or something?
Would it be my local one or one near the companys location?
