So can I ask, if the buyer has paid a certain sum to the Seller as a deposit , a large one I gather, so is the amount outstanding to the Seller enough to pay theYard instead ?

No. Seller owed yard 4x the 10% witheld by buyer.

I thought it had been sold to someone else for more money. It's gone. You won't get it now, however much you rely on ebay rules or the law.

It's not a unique situation in law, nor in the boating world, hence worth addressing legally, rather just from a common sense point of view.

In essence, one angle might be 'a sale of goods by a non-owner', the boat having been sold by someone (the original owner) other than the current owner (the original buyer).

The issue is similar to this one above, i.e. underlines the importance of identifying when ownership is transferred in contracts for the sale of goods.
