anti-ir35 (non-boaty) idea

it's a little bit boaty - ir35 seems to have put the kybosh on lots of boaty plans.

The idea is: what's to stop say three contractors banding together and starting a company? They trade as a company, bill time and draw salary, praps different salaries, have several customers, and so skirt most test issues. Sure, individual custmers might request individual consultants within the new company but so what? Individual barristers are requested in the same way. Would have to vat-registered probably, but not an issue for most, i think.

I don't understand this IR35 nonsense. A friend of mine in my last company took a contractor out for dinner last week. This contractor has worked for the same client for about 14 years!!

And the Client .........The Government!

I cannot see why it would not work, after all how is one supposed to start a small consultancy business that will one day become FI or WS Atkins? Unless of course the Government wishes to discourage the setting up of small consultancy businesses. I am actively considering such a scenario, It's more likely to work where the skills are complementary ie not everyone is a C++ programmer.

Met a few of these in the IT world already. Problems is when they as registered company get taken on by, say big insurance company. Goes through normal process, which can just about cope with individual consultants, but not small companies. Credit check is done, and turns out registered company has profit for last year of 0.02p. Insurance company won't work with little company as doesn't fulfill all sorts of internal rules on dealing with credit worthy companies.

Complete cobblers, but even mid sized IT companies get hit the same way. Lots of internal rules about dealing only with companies that will be round in 10 years to sort out the mess they created.
